42nd Meeting - 60th Session of Human Rights Council

Excellencies, distinguished colleagues, I call to order the 42nd meeting of the 60th session of the Human Rights Council. We will continue our consideration of draft resolutions and decisions. I am informed that resolutions that are ready to be considered now appear on the screen. All programme budget implications are available on the extranet.

Item 5 this morning, and I give the floor... Sorry. Item 3. Item 3, L5. Sorry. Thank you. Item 3, L5, and I give the floor to Members of the Council who wish to make explanations of votes before the vote on draft proposal L5. I give the floor to the distinguished representative of Cyprus.

Thank you, Mr. President. I have the honor to speak on behalf of the EU member states that are members of the Human Rights Council. This explanation of vote has been agreed by the EU as a whole. The EU promotes a human rights-based approach to inclusive and sustainable development, which is reflected in our development policy and cooperation. We work towards achieving sustainable development, the non-discriminatory realization of all human rights, eradicating poverty in all its dimensions, tackling discrimination and inequalities, and leaving no one behind. The EU and its Member States remain the world's largest official development assistance donor. We inter alia strive to support our partner countries in realising human rights obligations, which in turn facilitates rights holders claiming their rights. Mr President, the realisation of the right to development must be rooted in the universal, indivisible, interrelated and interdependent nature of all human rights. While States have the primary responsibility for the realization of all human rights, every individual person must be always and everywhere recognized as a rights holder. The EU thanks Uganda for leading, on behalf of the NAM, inclusive and formal consultations. We have participated constructively to ensure that the text aligns with the principle of universality of human rights, with individuals as rights holders and States as duty bearers. We have appreciated the frank and respectful exchanges of views, as well as Uganda's efforts to maintain a constructive and inclusive dialogue. The EU analyses a Human Rights Council resolution based on its merits and makes proposals aimed at reaching consensus. During negotiations, the EU raised serious concerns with the text that, inter alia, interferes with the OHCHR's independence. Despite diverging views on the right to development, particularly on a draft legally binding instrument, the EU will continue engaging constructively. While we sincerely appreciate that some of our suggestions were partly reflected in the tabled version, we regret that others were not, which prevents consensus to emerge. Taking this into account, the EU cannot support the draft resolution L5 and calls for a vote. The EU member states that are members of the Human Rights Council will be voting against it. I thank you.

Thank you.

I give the floor to the distinguished representative of Mexico.

Thank you, President. Mexico reaffirms its commitment to the right to development as a human right in step with the Declaration of 1986. In a context of political and economic instability around the world in which we see the questioning of the multilateral foundations, it is essential that we reiterate the link between sustainable development and human rights, as well as the role that can be played by this Council to promote and protect human rights, including the right to development. Human rights are universal, indivisible, and interdependent. They are mutually reinforcing. We do not share a focus that places conditions on human rights or that brings slippage in international standards in human rights. President, Mexico has decided to change the manner in which it promotes development nationally and has moved past the economic model that has caused so much inequality in our country. With this objective, the President, President Sheinbaum has launched the Mexico plan this year, which is a strategy for economic development that is equitable and sustainable. for prosperity and shared prosperity that this project seeks to change the economic paradigm nationally, underscoring explicitly that the model of economic development in Mexico seeks not just economic growth, but also, and in particular, the well-being of people. That is to say, development must be supported on two pillars. sustainability, and well-being. Plan Mexico places people that have been historically marginalized at the center of our national development. The concept of shared prosperity is one of the primary pillars of this plan. It reflects the commitment to equitable distribution of the benefits of development. For the aforementioned, Mexico will vote in favor of Resolution L.5, since it is in step with our national priorities in this matter. Mexico wishes to express its reservations as regards the negotiation of a legally binding instrument that codifies the right to development. Further, in the context of the severe restrictions on budget currently, we invite those promoting this draft resolution to evaluate how one can continue to address the right to development in a manner that is more efficient and effective, avoiding the duplication of efforts, bearing in mind the multiplicity of mandates that are currently existing. I thank you, Mr. President.

Thank you.

I give the floor to the distinguished representative of Spain.

Thank you very much. President, Spain joins the explanation of vote from the EU. And we also thank Uganda and the Group of Non-Aligned Countries for the celebration of consultations and the constructive negotiation of this resolution. We have sustainable development at the center of all of our policies, nationally and internationally. Our commitment to the multilateral funds and programs for development, including the work of the mechanisms of this council, is unbreakable. We agree with the High Commissioner that if we want to achieve the Sustainable Development Goals, there must be fundamental changes in our global priorities. The Sevilla Conference on Financing for Development in July addressed successfully many of the transformations that we wish to bring to ensure that all instruments available to us are ensuring that progress in development across the world. This progress must come hand in hand with generalized progress in the enjoyment of all human rights. Universality and indivisibility of them are at the essence of it. There is no subordination or hierarchy of some rights over others. For example, the duty to ensure equality between men and women or to not torture a population are absolute obligations for the states regardless of their levels of development. For this reason, we would have liked to see in the text presented today language that is more clear on this interrelationship and the nature of the mutually reinforcing nature of all human rights, as well as on the responsibility of States to these points. We recognize the work of the High Commissioner's Office and the mechanisms of this Council to bring an effective implementation of the right to development and, in particular, the work of the Special Rapporteur with a renewed mandate, having addressed substantial items such as the link between gender equality and the need to bring financing for development. However, it continues to be necessary, in our opinion, to bring greater reflection and greater consensus on the need for a legally binding instrument. that is in step with international law. Spain will continue to work in an open manner and constructively with those promoting this resolution in order to close the gaps that separate us in order to ensure that these resolutions reflect that indicated in the international fora and conferences, and so that it strengthens the irreversibility of human rights, including the right to development, focused on people. All of this brings us, as I have said, to join the position of the EU, and we will vote against this resolution. I thank you kindly.

Thank you.

I give the floor to the distinguished representative of China.

Mr. President, China thanks Uganda for submitting the draft resolution on the right to development on behalf of the NAM and for its efforts in this regard. Development is a universal and inalienable basic human right. The Chinese government pays great attention to the work of relevant mechanisms of the Human Rights Council. We pay great attention to the issue of the right to development. However, with the continued spread of unilateralism and protectionism, global deficits for peace, development, security, and governance are worsening. The UN 2030 Agenda for Sustainable Development is faced with serious setbacks, and the implementation of the right to development in the world remains an arduous task. The right to development as an inalienable basic human right has not received due attention from international community. We believe that all countries should follow the UN Declaration on the Right to Development, ensure the right to equal participation in development for its people, give full play to the contribution of development to the enjoyment of all human rights, and equally promote the protection of civil, political, economic, social, and cultural rights, as well as the right to development to ensure a life of dignity for everyone. Mr. President, we support the submission of the draft of the Convention on the Right to Development to the GA, and hope to continue strengthening international cooperation with all parties to promote the consensus, the consultation on this issue so as to jointly turn the commitments to the advancement of development and human rights into concrete actions. In view of the above, we will vote in favor of draft resolution L5, and we hope that all other members can also support this important draft resolution. Thank you, Mr. President.

We'll give the floor to the distinguished representative of Japan.

Thank you, Mr. President. We thank the delegation of Uganda and the NAM for this draft and the consultations as provided. Last year marked the 70th anniversary of the start of Japan's official development assistance programs. Over the years, we have partnered and supported 190 countries and regions, contributing to various fields such as healthcare, high-quality infrastructure, development, education, and capacity building. We have no doubt about the importance of development. Japan itself has been the benefit of ODA in its development. At the same time, We are of the view that the primary responsibility for the full realization of all human rights lies with the state. And with it, every individual person must always be recognized as a rights holder, regardless of where they live. Unfortunately, this draft resolution appears to protect states rather than individuals in the context of the right to development. Furthermore, we cannot support discussions that prioritize the development process over human rights. We recognize there are diverging views regarding the right to development. In such light, with respect to the legally binding instruments referenced in this draft resolution, discussions that jump to conclusions should be avoided. For these reasons, Japan is not in a position to support draft resolution L5 and will vote against it. We encourage other members to do the same. I thank you.

Thank you.

I give the floor to the distinguished representative of Iceland.

Mr. President, as firmly stated in Agenda 2030, human rights are essential components of sustainable development and vice versa. The premise of the SDGs to leave no one behind can help to promote inclusive development policies as well as to serve as a foundation for human rights promotion and development. We believe this is particularly important in our discussion on the right to development as well as on the link between development and human rights. It is also founded on our commitment in the Vienna Declaration, where we reaffirmed that democracy, development, and respect for human rights and fundamental freedoms are interdependent and mutually reinforcing. As a small state, Iceland's core interests are dependent on increased stability of the international system, improved protection of human rights, and strong democratic system worldwide. We therefore would like to continue engaging on the right to development in the context of the implementation of Agenda 2030 with a view to building a foundation for a common understanding among States. Elements in draft resolution L5, including references in text related to creating a legally binding instrument on the right to development, are not conducive to that goal. Having said that, in the vote, Iceland will abstain. I thank you.

Thank you.

I'll give the floor to the distinguished representative of Chile.

Thank you very much, President. The commitment of Chile to human rights is cross-cutting. It includes the civil and political rights, as well as economic, social, and cultural rights, and of course, also the right to development. This commitment is reflected in Chile's support for the Declaration on the Right to Development of 1986, the Declaration of Rio on the Environment and Development of 1992, and the Declaration and Programme of Action of Vienna in 1993. Our recognition of these rights is based in the central place we give to the rights of people. It is people, and not the States, that are the right holders. All action of this Council on the right to development should be focused on ensuring that all people can have access on equal footing to the benefits of development. It is for this reason that, as we expressed in 2023 and 2024, we continue to be concerned over the development of discussions on the right to development in this Council. Chile has been consistent in expressing its reservations on the creation of a legally binding instrument on the right to development, as we believe that we are still far from achieving consensus on its content, scope, and the nature of this right. We are aware that the discussions on an legally binding instrument are already underway at another headquarters or another duty station. We do call upon the Council here in Geneva to find a way towards consensus. At the same time, we lament that this new version incorporates references and updates that are far away from the matter of protecting human rights and that reflect instead bilateral matters. What should be important is a constructive dialogue. This language brings us further away from finding a road towards consensus. For all these reasons, Chile maintains its position of abstaining from this initiative. Thank you very much.

Thank you.

I would like to inform the Council that Chile withdrew its co-sponsorship for this draft proposal as reflected in e-delegate and was therefore able to intervene on this text. I give the floor to the distinguished representative of the Marshall Islands.

Thank you, Mr. President. The Marshall Islands would like to thank the UNDA on behalf of NAM for presenting draft resolution L.5 entitled "The Right to Development." The Marshall Islands is fully cognizant of the legitimate issue that development challenges pose to all of us. Like many developing states, we aspire to fully and equitably develop, thrive, and prosper. However, we must not forget that development should not be used as a certification for overlooking human rights, including the human right to a clean, healthy, and sustainable environment. Development using greenhouse gas consumption can inherently be detrimental to the environment of the Marshall Islands and the health of the global climate as a whole. Mr. President, we are of the view that the right to development is not and cannot be a right to carbonated development and must be read consistently with the Paris Agreement and club climate obligations. As the Special Rapporteur on Human Rights and Climate Change has underlined, development that fuels the climate crisis cannot fulfill human rights. Seeking development progress is an opportunity to create an enabling environment in which our citizens equally thrive and benefit from the opportunities that sustainable development brings. The Marshall Islands remain a vulnerable developing nation with serious challenges, but is committed to a climate-resilient, rights-based development, one that ensures the fulfillment and protection of the human rights of our population and future generations. Development must facilitate adaptation and climate resilience. While recognizing the legitimate aspirations of all developing nations, it is for these reasons that we will abstain on the draft resolution. Commodore Dada and I thank you.

Thank you.

I don't see any other requests for the floor. At the request of the delegation of Cyprus, the Council will now proceed to a recorded vote on draft proposal L.5. I ask the Secretariat to open the voting machine and request all delegations to register their vote. I request delegations to check whether their vote is accurately reflected on the screen. If so, I ask the Secretariat to close the voting machine. The voting is now closed. The result of the recorded votes are as follows: 28 in favour, 14 against, 5 abstentions. Draft proposal L5 is therefore adopted. Copies of the results of the votes will shortly be uploaded on the Extranet. The Council will now consider draft proposal L6 entitled "Arbitrary detention". I give the floor to the distinguished representative of France to introduce the draft text.

President, it is my honour to present draft resolution L6 on arbitrary detention, co-sponsored by 48 States. By adopting this resolution, the Council would allow the Working Group on Arbitrary Detention to continue its work for a new three-year period. The role of this mechanism has proved its effectiveness since it was created, and it is fundamental to document the practice of arbitrary detention in an impartial fashion. Arbitrary detentions, unfortunately, remain a widespread practice on all continents, depriving thousands of people of their freedom without due process. The working group has issued more than 1,000 views in 30 years of existence, and we underscore the collective efforts we need to undertake to put an end to arbitrary detention. The group's work is fundamental to protect individuals, promote the rule of law, and bolster state responsibility. Its mandate is preventive and corrective, and is crucial to combat impunity and ensure respect for fundamental rights. By adopting this resolution, the Human Rights Council would underscore the importance of this working group which is a model for the special procedures. It offers victims not only a recourse, a remedy, when they cannot access this in their own country, but also recognition of their rights. By documenting these cases and bringing the international community's attention to this, the Working Group breaks silence and combats impunity, and contributes to the release of arbitrarily detained persons and the revision of abusive laws. This revision would allow the working group to respond to the growing number of allegations of arbitrary detentions based on information from all interested parties in a spirit of dialogue and cooperation with States. President, France warmly thanks all of the States who, through their co-sponsorship and constructive comments, have expressed support for this resolution and for the group itself. Its concrete and crucial work allows for protection and a counterweight against this abuse of power. This is why France supports the adoption of this resolution by consensus. Thank you.

The Secretariat that there are seven additional co-sponsors and I'll give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Spain.

Thank you very much. Spain appreciates France for presenting L6. It addresses a matter that is of particular concern to us, that is to the proliferation of arbitrary detention. It is a practice that is incompatible with international humanitarian law and international human rights law. Spain condemns this in the firmest terms. We reiterate our support to the Working Group on Arbitrary Detention for its mandate and for its efficiency. Its work has led to, effectively, the liberation of dozens of individuals the world over over recent years, in addition to the recommendations and attention that they pay to the families of the victim members that suffer from illegal detention. The resolution L6 allows the working group to continue with its work, together with the support of the Office of the High Commissioner's Office. And we encourage all states to cooperate fully with this special procedure, which is essential. We are particularly concerned over the reprisals against those who are going to the international system for the protection of human rights system. We call for the firm and immediate and unconditional liberation of all those that find themselves deprived of liberty arbitrarily. and particularly human rights defenders, journalists, and members of political opposition. It is unacceptable that there is an abuse of power to silence those who are just doing their job. Discrepancies, criticism should not be criminalized and punished with deprivation of liberty without legal foundation. Spain rejects the use of threats and intimidations by states as a structural means of persecution. to this, whether it's in Russia with the gagging of intellectuals, or international waters with the illegal detention of activists, humanitarian activists, of the global Flotilla, or in any other part of the world. For all of these reasons, we reaffirm our support for resolution L6, and we call for its adoption by consensus. I thank you kindly.

Thank you.

I give the floor to the distinguished representative of Cuba.

Thank you, President, and a good afternoon. We thank the delegation of France for having presented draft resolution L.6. Arbitrary detention is a practice that is prohibited and punished by Cuban legislation, and it is not in step with the reality in our country. The Cuban delegation supports the renewal of the mandate of the Working Group on Arbitrary Detention for a period of three additional years. as set forth in the draft resolution in its preamble or paragraph six, this group has the duty to act in strict adherence with the institutional packet, including the resolutions 5/1 and resolution 5/2. on the code of conduct. We emphasize the importance of the working group acting at all times with objectivity, without taking on preconceived opinions on any case. It should duly bear in mind the responses of the concerned states. looking into the veracity of information received from different sources and not accepting the allegations that are clearly false and manipulative, sent by actors that seek to abuse the system with goals that are completely outside of the goal of human rights protection. We reiterate our will to continue to cooperate systematically and constructively with the Working Group on Arbitrary Detention. This is in step with the firm commitment of Cuba to the promotion and protection of all human rights for all people without discrimination. For the aforementioned reasons, Cuba supports draft resolution L.6, and we will join consensus. Thank you very much.

Thank you.

I leave the floor to the distinguished representative of South Africa.

Mr. President, South Africa wishes to provide general comments on resolution L.6 on arbitrary detention. My delegation expresses its gratitude to France for this initiative. Indeed, this resolution is extremely important for South Africa. We know all too well the pain and suffering associated with arbitrary detention, which was one of the tools regularly invoked by the apartheid state to crush any dissent. We similarly know how arbitrary detention was used in conjunction with torture, resulting in the deaths of countless individuals whose broken bodies told the story of the unimaginable horrors that they were forced to endure. In 1991, the same year that the then UN Commission on Human Rights established the Working Group on Arbitrary Detention, whose mandate Resolution L.6 seeks to renew, it similarly considered a resolution on the detention, torture and other inhuman treatment of children in South Africa. Accordingly, South Africa commends the vital work undertaken by the Working Group, not only then, but also today. The Working Group more recently considered the case of two South Africans contributing to their release by the State concerned. In welcoming the resolution, South Africa acknowledges that this year, France sought simply to provide a technical update to the text. We do, however, believe that it is essential to place this resolution in context, and do hope that in future, we will be allowed the opportunity for this. Much like under apartheid, sorry much like under apartheid we are seeing how those seeking to realize the inalienable right to self-determination and are engaged in legitimate struggles against foreign occupation are increasingly subject to arbitrary detention this is the case both on the African continent and Beyond by way of example Israel's systemic use of arbitrary detention which has always been a feature of its efforts to maintain its unlawful occupation has increasing insignificantly since 7th October 2023 as part of ongoing genocide against the Palestinian people. Similarly, the very same occupying powers fail to implement the recommendations of and routinely engage in reprisals against those individuals and their families who seek to cooperate with the working group. In closing, South Africa therefore calls on the Council to ensure an end to this abhorrent practice once and for all and the provision of effective remedies and reparations for victims and survivors. In so doing, let us be reminded of the haunting words of the chair rapporteur of the working Group during the recent interactive dialogue, when she stated that behind every case in our files is a person whose freedom was taken unlawfully, a voice silenced, a life interrupted, a family torn apart by the arbitrary exercise of power. I thank you.

Thank you.

I have been informed by the Secretariat that there are PBIs for this draft proposal. Sorry, China has a general comment.

No.

China has a general comment? EOB. EOB, okay. So let me go back to the PBIs. The total amount is $1,579,400. $1,275,400 is already included in the program budget. 304,000 will be added to the budget. And I'll give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I give the floor to the distinguished representative of China.

Mr. President, fair administration of justice is the last line of defense for safeguarding social fairness and justice. China firmly opposes arbitrary detention and citizens personal freedom shall not be violated. At the same time, freedom and rights are not absolute. International human rights conventions clearly stipulate that when exercising rights and freedoms, citizens shall abide by the law and shall not harm public security, public order, or the legitimate rights and freedoms of others, and no one shall be above the law. The Working Group on Arbitrary Detention has also has the obligation to perform its duties fairly, objectively, in accordance with the mandate of the Human Rights Council and the Code of Conduct of Special Procedures, and to use true and reliable sources of information. The Chinese delegation has actively participated in the consultations on the relevant draft resolution L6, and thanks co-sponsors for conducting constructive communication and dialogues with all parties. However, the current draft resolution still has flaws and have different views in our view, including relevant provisions such as directly citing controversial report of the working group and requesting member states to consider the views of working group are unbalanced and objective. We hope the draft can be more balanced and objective. In view of the above, the Chinese delegation will not associate itself with the consensus of the draft resolution. Thank you, Mr. President.

Thank you.

I don't see any other requests for the floor. Is there a request for a vote? I see none. May I take it that draft proposal L.6 may be adopted without a vote? It is so decided. Thank you. The Council will now consider draft proposal L10 entitled the human right to safe drinking water and sanitation. I give the floor to the representatives of Germany and Spain to introduce the draft text. Germany first, you have the floor.

Thank you, Mr. President. On behalf of Spain and my own country, Germany, I have the honor to introduce draft resolution L60/10, the human rights to safe drinking water and sanitation. Access to safe drinking water and sanitation are among the most fundamental human needs. This is why Spain and Germany have worked together for almost two decades to have them recognized as what they are, as human rights. Today, we are still far away from achieving sustainable development goal six, ensuring availability and sustainable management of water and sanitation for all. More than 2 billion people around the world have no access to safe and affordable drinking water. More than 3.5 billion lack access to safely managed sanitation. Climate change, rapid urbanization, and technological change are intensifying water scarcity. The water crisis affects health, but also dignity. and economic opportunity, particularly for women and children who often bear the burden of collecting water. The UN is taking decisive steps to accelerate progress towards SDG 6 with its system-wide water and sanitation strategy, as well as two UN water conferences scheduled for 2026 and 2028. We have a good momentum for change. I have the honor now to hand over to my Spanish colleague to elaborate how this year's iteration of the resolution strives to address the ongoing challenges. Thank you.

Yes, Spain, please.

Thank you, President. Our objective with the presentation of this resolution is not really to renovate the mandate of the Special Rapporteur for Water and Sanitation, but rather also to make it more effective. With this goal, we have introduced changes to ensure the active participation of the rapporteur in the upcoming conferences of the United Nations on water in 2026 and 2028. It is thus to ensure that special emphasis is made on the human rights dimension at those conferences. Also, to tackle the current liquidity crisis of the system, we have opted to streamline the presentation of reports between New York and Geneva. The changes that we have incorporated are aimed at strengthening the mandate and not weakening it, given the budgetary concerns. We believe that this alternating of reports is a constructive approach towards the streamlining that we hope to -- to a streamlining we hope that will serve as an inspiration to future mandates or other mandates. President, colleagues, we thank all delegations that have participated actively in this, with Germany and the work that's led to this. We would like to indicate to the delegations that have expressed interest in being co-sponsors, we thank them. Once again, please, we would like for universal support for these human rights through the adoption of this resolution by consensus. Thank you very much.

Thank you.

I give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Mexico.

Thank you, President. We would like to express our full appreciation to Spain and Germany for their leadership in this draft resolution, L10. In order to streamline, we appreciate the procedural approach adopted by the group, as well as the openness during the process of informal consultations to renew the mandate of the Special Rapporteur on human rights to drink potable water and sanitation is essential for the promotion of a sustainable approach that is human rights based in the management of water. This mandate has brought the progressive realization of human rights and enjoyment of human rights to water and sanitation from an intersectional perspective, recognizing the many barriers and means of discrimination that disproportionately affect individuals that find themselves in a situation of vulnerability. For the aforementioned, we'd like to reaffirm anew the renovation of this mandate. And also, in turn, due to the cross-cutting nature of human rights, we back this draft resolution. We support it bringing the involvement in the preparatory conferences of 2026 and 2027 on water and sanitation. This will allow for the human rights dimension, including gender equality, be reflected appropriately in the agenda and that results from those conferences Mexico calls upon the council to adopt the draft resolution L 10 by consensus much obliged president.

Thank you I have been informed by the Secretariat that there are 17 additional co-sponsors and I give the floor to the distinguished representative of Benin.

Thank you president president Benin thanks Germany and Spain for draft L10 on the renewal of the mandate on the special rapporteur on safe drinking water. We have made this area an absolute priority of our government's action in recent years. In this context, access to safe drinking water and sanitation are subject to constant attention through mass investment in dedicated infrastructure, especially in rural areas, and the establishment of an integrated and resilient approach to water resource management. Thanks to these strategic investments promoted by the Eurobonds in 2021, the first successful such project in Africa, we are now effectively on the way to achieve SDG 10 by 2030. There was an increase in recent years, a major increase in water coverage in rural areas, in rural areas that is, and an increase by 15% in urban areas in the same period. The aim is to achieve 100% coverage coverage by 2026. However, significant challenges remain in Benin and elsewhere for the effective achievement of SDG 15. This is why the renewal of the Special Rapporteur's mandate is essential to highlight the important role of access to safe drinking water and sanitation to achieve other goals in a concerning context in terms of achievement of the SDGs globally. It is Benin's pleasure to join the list of co-sponsors of L10, and we therefore call on the members of the Council to adopt it by consensus. Thank you.

English representative of Cuba.

Thank you, President. We thank the delegations of Spain and Germany for having presented draft resolution L10. Cuba supports the renovation for an additional three years of the mandate of the Special Rapporteur on the right to safe drinking water and sanitation. That would allow for continuity to the work undertaken in a matter of crucial importance for all countries. The promotion and protection of the right to drinking water and sanitation, safe drinking water and sanitation, has a decisive role in the rights of all human, on the lives of all human beings, given that it directly affects food, health, and hygiene. prevention of diseases, agriculture, and economic and industrial sectors, among others. We hail the fact that this resolution reflects the collective political will of moving forward on a matter that is a priority for developing countries that see themselves disproportionately affected by water scarcity and drinking water and a lack of resources necessary for its adequate use and handling. We also recognize the willingness of the sponsors to address to make the reporting periods biannual. We urge the Special Rapporteur to continue to give priority to cooperation efforts, technical assistance, and support capacity building for states that requested this would be a practical support for the promotion and protection of human rights to safe drinking water and sanitation for the aforementioned reasons Cuba supports draft resolution L10 and we hope that it can be adopted by consensus thank you kindly.

Thank you give the floor to the distinguished representative of Costa Rica

thank you president.

On 23 July 2025, the International Court of Justice issued an historic consultative opinion. It was a very important legal guide in a matter of human rights and the environment. In its ruling, the court determined that the human right to a clean, healthy, and sustainable environment is a precondition for the enjoyment of numerous human rights, such as the right to life, the right to health. and the rights to an adequate level of quality of living, including access to water. The court has consolidated, thus, the principle of the interdependence of human rights. In this regard, the human rights to safe drinking water and sanitation are part of this holistic legal guide from the highest court within the UN. It is for this reason that the draft document L10 takes on a renewed role in contributing to this reinforced legal reality. The rapporteurship that we'll be renewing today is called upon to bear in mind what the court has indicated. Without proper protection for the human right to safe drinking water, supporting biodiversity efforts, avoiding desertification, and preventing pollution by plastics or chemicals. Without this, it would be possible to ensure effective enjoyment of the right to safe drinking water and sanitation. Costa Rica thanks the delegations of Spain and Germany for having presented this draft, and we hail the fact that this text urges the Special Rapporteur to participate in venues beyond this forum. Special procedures are very valuable tools for the promotion of human rights, and in particular in environmental matters. My country is convinced of the need to have a united front and to leverage the power of numerous rapporteurships that should be present to have an impact on the different assemblies and global work being done on plastics, biodiversity, climate change, the ocean, desertification, water, and others. Costa Rica has continued with its historic co-sponsorship of this historic resolution. We are certain that in the next substantive version, it will have an explicit mention of the human right to a clean, healthy, and sustainable environment. We call for its adoption without a vote. Thank you. Thank you kindly.

Thank you.

I give the floor to the distinguished representative of Kenya.

Thank you, Mr. President. We thank Germany and Spain for presenting this draft. We reaffirm that the human rights to safe drinking water and sanitation are essential for the full enjoyment of life and all other human rights. In this regard, Kenya underscores the vital role of the Special Rapporteur's mandate in deepening understanding, promoting accountability, and advancing technical cooperation to support States in realizing these rights. The continuation of this mandate ensures expert guidance and constructive dialogue, particularly for countries mostly affected by water scarcity, drought, and climate-related challenges. Kenya further stresses that our region faces growing pressures from climate change, desertification, and fluctuating rainfall patterns, all of which threaten availability and quality of water resources. These are not distant challenges. They're immediate and existential. They undermine livelihoods, heighten the risk of displacement, and strain social and economic systems. Against this backdrop, the work of the Special Rapporteur remains indispensable in connecting human rights to principles, to concrete climate adaptation and water resilience strategies. and we welcome the engagement during the upcoming UN water conferences. We emphasize the importance of strengthening international cooperation and solidarity in addressing these interlinked crises. No country can meet them alone. Kenya called for enhanced capacity building, technology transfer, and predictable financing for sustainable water infrastructure, especially in developing and climate-vulnerable regions. The mandate holder, engagement with states, UN agencies, and financial institutions should continue to foster practical solutions that leave no one behind. Finally, Kenya supports the renewal of the special rapporteur's mandate and encourages the mandate holder to maintain close collaboration with regional mechanisms and local communities, ensuring that lived experiences from the ground inform global deliberations. Thank you.

Thank you.

I give the floor to the distinguished representative of the Dominican Republic.

Thank you, President. The Dominican Republic would like to thank Spain and Germany for having presented draft resolution L.10. we recognize the value of this initiative it gives continuity to an essential mandate for the promotion of human rights which are in essence a right the right to life health and human dignity we appreciate that the text reaffirms the commitments taken on within the 2030 agenda for sustainable development and in particular six it extends the mandate of the special operator on the right to safe drinking water and sanitation for a period of three years the work has been clear in strengthening and governance of water and promoting universal access to these fundamental rights. Further, we value the emphasis on the technical cooperation and capacity building, particularly in the context of the preparations for the UN Conference on Water 2026 and the final review of the Decade of Water 2028. ensuring that the human rights based approach, gender equality and inclusion are fully incorporated into the international water agenda. For developing countries, ensuring access to water and sanitation is also a matter of social justice, resilience and sustainable development. For this reason, this resolution not merely renews a mandate, it also reaffirms the collective obligation of protecting hydric water resources and sustainable and equitable management. Lastly, the Dominican Republic as a co-sponsor, normal co-sponsor of this, calls upon all member states to support this resolution by consensus as a concrete expression of our commitment to human rights and to a future in which access to water and sanitation is a reality for one and all. Thank you very much, Mr. President.

Colleagues, you have three minutes speaking time in this slot, so please slow down a little bit and make life for interpreters a little easier, and then for all of us. I have been informed by the secretariat that there are PBI for this draft proposal. The PBIs amount to a total of 2.5 million. 214,400, which is 25,300 less than was originally included in the budget. That's a good information for once. And I'll give the floor to members of the Council who wish to make explanations of votes before the vote on this draft proposal. I don't see any request. I give the floor to the distinguished representative of the Gambia.

Thank you, Mr. President. It's actually a general comment. Our flag has been up.

I mean, so it's a general comment.

Sorry about that. Thank you very much. The Gambia thanks the Core Group of States for presenting this very important resolution and the continued attention given to the vital human right to safe drinking water and sanitation. Access to safe and affordable water and sanitation It's a for the enjoyment of the right to life and dignity and remains a cornerstone of the 2030 agenda for sustainable development, particularly goal six. Ensuring universal access to safe drinking water and sanitation requires sustained investment, political will, and a spirit of solidarity. For many developing countries, including the Gambia, water scarcity, inadequate infrastructure for water and sanitation, pollution, and limited management resources significant challenges that undermine the attainment of this right and require urgent action. Therefore, we welcome the renewal of the mandate of the Special Rapporteur and appreciate the emphasis placed on cooperation with States and stakeholders to promote the progressive realization of this right. We salute the resolution's focus on the upcoming United Nations Water Conference in 2026, co-hosted by our neighbors Senegal and UAE. as well as the Decade for Action and Water for Sustainable Development, which provide key opportunities to strengthen global partnership in this area. In this spirit, The Gambia is pleased to support and join consensus on this resolution and will continue to engage constructively in efforts to ensure that no one is left behind in this very crucial endeavor of ensuring safe drinking water for all. Thank you.

Thank you.

I give the floor to the distinguished representative of Bolivia, also for a general comment.

Gracias, President. Thank you, President. For general comments, we thank the distinguished delegations of Germany and Spain. Thank you for having presented this draft resolution. Fifteen years ago, the General Assembly of the United Nations recognized access to safe drinking water and sanitation as an essential human right, and since 2016, this Council adopted the resolution that affirms this right, underscoring its direct link to human dignity and health. In the vision of our country, water is the basis of life itself. Ensuring access to it and avoiding climate change is urgent. Redoubling our efforts to ensure that the right to water be protected, and particularly for the most vulnerable populations, such as the rural populations, women, and children, is essential. It is us at Bolivia supports the renovation of the mandate of the Special Rapporteur in this key moment. We hail the fact that this encourages participation beyond the scope of this council, and in particular, in the Water Conference of the United Nations. It is essential that we move forward towards concrete solutions. We must recognize that the right to water does not just mean access. It also refers to the quality, availability, and accessibility. This includes providing adequate infrastructure, sustainable use, and the eradication of inequalities that exist in the access to this resource. It is for this reason that we have become a co-sponsor of this draft resolution, and we call for its adoption by consensus. Thank you kindly.

Thank you.

I now give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I don't see any requests for the floor. Is there a request for a vote? I see none. May I take it that draft proposal L10 may be adopted without a vote? It is so decided. Thank you very much. The Council will now consider draft proposal L.15 entitled the human rights of all the persons. I give the floor to the distinguished representative of Argentina to introduce the draft text. Is Argentina here?

Not here.

Okay, we will go to the next one. The Council will now consider draft proposal L19 entitled the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. And I give the floor to this distinguished representative of Brazil to introduce the draft text.

Thank you, Mr. President. It is my privilege to introduce, on behalf of Brazil, the draft resolution entitled "The right of everyone to the enjoyment of the highest attainable standard of physical and mental health." This resolution renews the mandate of the Special Rapporteur on the right to health, first established in 2002 by the former Commission on Human Rights. Over more than two decades, this mandate has proven instrumental in clarifying States' obligations, identifying good practices, and addressing challenges to the full realization of this right. The present initiative seeks to ensure its continuity for a further period of three years. Mr. President. The text reflects indispensable and consensual updates, including the recent adoption of the WHO Pandemic Agreement, and highlights the Special Rapporteur's important contributions. Among them, we recall the reports on digital innovation, technologies and the right to health, and on health and care workers as human rights defenders. These thematic studies have enriched human rights standard setting and provided guidance on governance, development, and protection of those at the frontline of health systems. The DRAP resolution was discussed in an open and constructive manner. We have sought to ensure a concise and consensual text that brings delegations together around the continuity of this mandate. which has demonstrated tangible impact through both country visits and thematic reports. Mr. President, we trust that this resolution, as in previous years, will receive the strong support of this Council and be adopted by consensus today. Thank you.

Thank you.

I have been informed by the Secretariat that there are 24 additional co-sponsors, and I give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Cuba.

Thank you, President. We thank the delegation of Brazil. Thank you for having presented draft resolution L.19. Cuba supports the renewal of the mandate for the Special Rapporteur on the right to all, to everyone, to the enjoyment of the highest attainable standard of physical and mental health. The enjoyment of the right to universal health that is free and of high quality is a high priority for the Cuban state and a reality for our people, even in circumstances in which we are besieged by the United States and the economic damage of the embargo, our country continues to provide free, universal access to healthcare services for the entirety of our population, reaching extraordinary results in the area of biotechnology and pharmaceuticals. Despite the dishonest hate campaign against the Cuban healthcare professionals by the government of the United States and the intimidation exerted on those countries that receive this help, The benefits offered by our doctors are undeniable. Our doctors, nurses, and healthcare professionals have, throughout the world, saved more than 12 million lives. We have undertaken more than 16 million surgical interventions, and we have helped more than 5 million -- participated in more than 5 million deliveries, and millions have recovered their vision. due to our Operation Miracle, we call upon the Special Rapporteur to address in the mandate the impact of the medical cooperation, bilateral, regionally, and internationally, in helping to support the enjoyment of health. We continue to undertake constructive exchanges and technical assistance within the framework of this mandate as part of its firm commitment to the right to health. We reiterate our support to the agreement for the prevention response to and recovery from pandemics adopted by the WHO in May of this year. This agreement is an important step forward when it comes to strengthening collective action. Its implementation, successful implementation, requires greater international cooperation, and if they are to ensure economic resources for developing countries, including other additional resources that are sufficient and predictable, we are certain that the which can contribute to these efforts to effectively tackle pandemics. For the aforementioned reasons, Cuba supports draft resolution L.19, and we will join consensus as regards the same. Thank you very much.

Thank you.

I give the floor to the distinguished representative of Belgium.

Belgium thanks Brazil for this important initiative and for its constructive approach during negotiations on the text. It supports the renewal of the mandate of the Special Rapporteur to ensure that all persons can enjoy the best state of physical and mental health possible. Over the years, this mandate has shown itself to be a key Council instrument, highlighting the various dimensions of the right to health, including the often overlooked issue of mental health. Regularly bringing these issues before the Council contributes to the realization of this right by encouraging states to respond to existing and emerging challenges. Belgium believes the universal right to health as a cornerstone of its foreign policy and official development assistance. We call for equitable access to healthcare to ensure that no one is left behind. The COVID-19 pandemic highlighted the urgency of stepping up global healthcare governance, leading to the historic adoption of the first pandemic agreement. This is a key step towards greater global engagement. The right to health covers the physical and mental aspects and is essential to allow everyone to fully enjoy their potential, to promote prosperous societies, and to create conditions for lasting peace. This mandate therefore holds a key place in the human rights architecture as a fundamental mechanism for the promotion and protection of the right to health in all of its dimensions. For these reasons, Belgium supports resolution L19 and calls on member states of the council to support its adoption by consensus. Thank you.

The word to the distinguished representative of Costa Rica.

Thank you, President. Costa Rica, thanks, Brazil. Thank you for presenting this draft on the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. This right is closely tied to human dignity. sustainable development and the full enjoyment of economic, social, and cultural rights, as well as civil and political rights. Physical and mental health are inseparable in their dimensions. They are interdependent, and they are essential for comprehensive well-being for humans. With this reality, my country underscores that the International Court of Justice, in its historic advisory opinion in 2025, in July, concluded that the human right to a clean, healthy, and sustainable environment is an essential precondition for the enjoyment of numerous human rights, including the right to health. We wish to underscore that the draft resolution underscores the importance of the social determinants in health and the need to create favorable conditions nationally, regionally, and internationally to this end, and so that all people without discrimination can fully enjoy this right. It includes attention to inequalities that disproportionately affect groups that find themselves in vulnerable situations. Costa Rica believes that it is also essential that the special rapporteurship mandate be on health be renewed. This is a mechanism that has contributed to guiding states towards stepping up their legal framework. designing public and designing public policy with the human rights based approach we urge all states to fully cooperate with the mandate holder including by by responding favorably to requests for visits Costa Rica reiterates its commitment to the promotion of protection of the right to to everyone to the enjoyment of the highest attainable standard of physical and mental health. And we encourage that this document, L19, be adopted by consensus. Much obliged.

Thank you.

I give the floor to the distinguished representative of Ghana.

Mr. President, Ghana welcomes the tabling of draft resolution L19 and thanks Brazil for their diligent work and constructive engagements throughout the negotiation process. We commend the efforts to develop a text that strengthens the global framework for the promotion and protection of the right to the highest attainable standard of physical and mental health. The resolution underscores an important universal truth that health is a fundamental human right, indivisible and interdependent with all other rights. It rightly emphasizes the need for non-discrimination, solidarity with the most vulnerable, and the protection of mental health as an integral part of overall well-being. These principles resonate strongly with Ghana's ongoing national efforts to ensure equitable access to healthcare for all citizens, including through the National Health Insurance Scheme and initiatives supporting older persons, women, and other vulnerable groups. Mr. President, Ghana acknowledges the critical role of the Special Rapporteur in monitoring and promoting the right to health. We encourage all States to cooperate fully with the mandate holder, including responding positively to country visits requests, and to give due consideration to recommendations aimed at strengthening health systems. We are confident that adoption of this resolution would further reinforce international cooperation and promote the realization of health as a fundamental human right for all. Ghana looks forward to the continued engagement of the Council on this important matter. I thank you.

Thank you.

I give the floor to the distinguished representative of the Dominican Republic.

I will try to read as slowly as possible, says the speaker. The Dominican Republic thanks Brazil for having presented L19 on the right to the enjoyment of the highest attainable standard of physical and mental health. as well as the process of consultations, which was inclusive in drafting this, our country affirms that health is a fundamental human right. It is crucial for the enjoyment of all other rights. This right is not just limited to the lack of illness. It also means equitable provision of quality services, primary health care that is universal, and elimination of all forms of discrimination, and access also to sanitation and health care. It guarantees the right to health as an essential responsibility of the state. Our national domestic framework guides public policy toward universal coverage and the prevention and comprehensive coverage for people guaranteeing equitable access to quality healthcare services without discrimination of any kind are essential obligations of the states and a central pillar of our 2030 agenda, sustainable agenda, sustainable development agenda also. Mental health is part and parcel of the right to health and should be addressed with the same commitment, amount of resources and respect for human dignity as physical health. We recognize the importance of the mandate for the special rapporteur on the rights of health and the contribution in identifying best practices, technical cooperation, and the promotion of a human rights-based approach, and in particular, through the global challenges that have arisen with the pandemic and mental health care crisis. The Dominican Republic would like to reiterate its commitment to the promotion of inclusive health care policies that are sustainable and human-focused, that include a gender approach, gender equality, health and universal access to essential services. It is in this spirit that we fully support the adoption of this resolution by consensus, and we invite members of the Council to adopt the same, convinced as we are that it reflects collective action for well-being, dignity, and the right to health for all individuals on equal footing. Thank you very much, Mr. Chairman, Mr. President.

Very good, thank you. I have been informed by the Secretariat that there are PBIs for this draft proposal. The PBIs amount to a total of $257,100. This amount has already been included under the program budget for the relevant years. I now give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I don't see any requests for the floor. Is there a request for a vote? I see none. May I take it that draft proposal L19 may be adopted without a vote? It is so decided. Thank you very much. And the Council will now consider draft proposal L15 entitled the Human Rights of Older Persons. I give the floor to the distinguished representative of Argentina to introduce the draft text.

Thank you very much. Thank you, President. It is a great honor for me, on behalf of the entire group, Argentina, Brazil, and the Philippines and Gambia, to present this draft resolution, L.15, on the renewal of the mandate for the independent expert on the enjoyment of all human rights of older persons. This CoGroup would like to underscore the valuable work that the current independent expert, Dr. Claudia Mallet, has undertaken over nearly six years at the helm of this mandate. Her work has been essential when it comes to changing perceptions, underscoring the fact that older persons are not mere beneficiaries of social services, they are right holders with a right to dignity, equality, and participation in society. We also appreciate, I would like to express our deepest appreciation to the delegations that participated constructively with commitment and vision in the informal discussions, including during a agenda replete with crucial items. All of the participation is not merely a diplomatic exercise. It is also a declaration indicating that human dignity is important. We wish to sincerely thank all delegations that have decided to co-sponsor this resolution. We urge other delegations as well to follow their example. Your support transmits a clear message. That is to say that the rights of older persons, President, is not merely a matter of convenience, it's a matter of justice. This resolution shows more than consensus. It shows courage, courage to affirm that all individuals, regardless of their age, deserve the full enjoyment of human rights. This mandate, established in 2013, is as urgent as it was then. Let's be clear, the aging of the population around the world is not a trend that can be ignored. It is a reality that calls for action. This resolution, President, is more than a document. It is a call for a conscience. It is a vision of renewing our commitment to a world in which older persons not be left behind, in which their dignity is respected and in which justice is not postponed. It opens the door to a legally binding instrument based on resolution 58/13, adopted by this Council on 2 April. When the open-ended working group begins its work, we hope that all delegations will remain united, working towards justice. Let us unite for justice and dignity. Let us unite as well for the simple truth that human rights do not age. Let us unite for dignity and humanity and our commitment to protecting them. Our commitment should not age either. This should be our commitment. This is our mission. Let us move forward, not tomorrow or some other day, but rather today, with a firm step and hope. Thank you very much.

Informed by the Secretariat that there are 19 additional co-sponsors, and I now give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Mexico.

Thank you. Thank you, President. We wish to express our appreciation to the core group of this draft resolution, L.15. Thank you for your leadership for the renewal of the mandate for the independent expert on the rights of older persons. Addressing the needs and experiences of older persons with a broad and comprehensive human rights-based approach is a priority for Mexico. To complete the commitment of not leaving anyone behind, it is essential that we promote the full and meaningful participation of the older persons in their diversity, fostering their autonomy, independence, non-discrimination, inclusion, and well-being. As indicated in this draft resolution, we should recognize, we have to recognize the essential contributions of older persons to our societies. It is along these lines that it is important that we recognize their contributions to the achievement of the 2030 agenda. We lament that that has not been included in the text. President, for Mexico, it is essential that we bring continuity to the work of the independent expert. That includes awareness raising and bringing greater visibility on the challenges in the protection and achievement of the rights of older persons so that they can live in societies that are more inclusive and equitable. Further, we positively value the recognition of the new intergovernmental working group, which was established through resolution 58/6. stroke 13 for the aforementioned reasons we have co-sponsored draft resolution l15 we call upon states to adopt it by consensus thank you very much mr.

president thank you if the flow to distinguish the representative of Brazil

thank you mr. president draft resolution l15 has a procedural character but a very important one. The resolution renews the mandate of the independent expert on the enjoyment of all human rights by older persons. Rapid demographic changes are redesigning the world, where a growing older population faces challenges such as ageism, poverty, and inadequate access to health care and social protection. The mandate of the independent expert helps the international community to promote and protect the human rights of older persons, while also helping every person to face the challenges of aging well. The draft also welcomes resolution 58/13, adopted last April. It was a landmark achievement for this Council. The intergovernmental working group it has created is going to be an essential forum for the discussions of the rights of older persons, with a view of establishing a future legal framework for the international community. We call upon all States to join the movement in supporting the rights of older persons, demonstrating our collective commitment to building a more just and inclusive society for all generations. While concluding, Mr. President, Brazil would like to thank the independent expert, Dr. Claudia Mahler, for her outstanding work at the head of this important mandate. Thank you very much.

Thank you.

I give the floor to the distinguished representative of Colombia.

Thank you very much, President. Colombia welcomes draft resolution, this draft resolution for the renewal of the mandate for the independent expert on the human rights of older persons. And we thank Argentina, Brazil, and Slovenia for having presented it. In a world that is aging quickly, it is essential that we ensure that all individuals in all stages of their lives enjoy their rights on equal footing with dignity and autonomy. We would like to reiterate Colombia's support to the mechanisms of the Human Rights Council and, in particular, to the valuable work of the special procedures. These mandates are essential tools when it comes to promoting and protecting specific rights and for bringing visibility to challenges faced by groups that find themselves in vulnerable situations. In this case, the contribution from the independent expert on the enjoyment of all human rights by older persons. We, however, would like to express respectfully our concern that the text has modified the way in which reference is made to the SDGs. For Colombia, it is essential that we preserve the language, previously agreed upon language, and that this, as this reflects agreements reached in the General Assembly, the 2030 Agenda is a common roadmap. It reminds to us the principle of not leaving anyone behind. For this reason, we urge that the mention of it remain in their consolidated form. Without hesitation, we invite all Member States to fully move forward in supporting the enjoyment of the human rights of older persons around the world and to thus continue to build on consensus, this Council should have a focus, an approach on cooperation that is based on multilateralism. It is for this reason that we created the United Nations, with the urgency of ensuring peace and development and human rights, including, importantly, the human rights of older persons. This is more or as or more present as they need as we saw 50 years ago, as we can see with our older persons. Thank you very much, Mr. President.

Thank you.

I'll give the floor to the distinguished representative of Cuba.

President, we thank the sponsors for L15. Cuba reiterates its commitment and support to the 2030 Agenda and the 17 SDGs. The effective implementation of this agenda will positively impact the enjoyment of the rights of older persons. Our delegation opposes any attempt to undermine the relevancy of 2030 Agenda or to hindering its implementation. This is a priority in our country, that is to say, to bring the -- to satisfy the needs and the quality of life of the older persons and to respect their self-determination, ensuring their full enjoyment of their rights, promoting their integration and incorporation in social life. Cuba supports the renewal of the mandate for the Special Rapporteur on the human rights of older persons. We will continue to cooperate with the mandate holder in a constructive manner. in an active manner, the contribution of this mandate is essential to making visible the reality of older persons and in bringing concrete strategies to prevent them facing problems in a concrete manner, given the national realities and socioeconomic capacities of our States. This mandate can support efforts aimed at bringing about a legally binding instrument. It is broad and comprehensive when it comes to promoting and protecting rights, dignity, and the well-being of older persons. Cuba supports the adoption of this very necessary instrument in the briefest time period possible. Clearly, the mandate should contribute to the implementation of the remaining actions that have been agreed upon by our countries under 14.1 of the Working Group of the General Assembly of the UN on aging. For the aforementioned reasons, President, I conclude noting that Cuba will support this draft resolution L15 and we will join consensus as regards the same. Thank you very much, Mr. President.

Thank you.

I give the floor to the distinguished representative of Ethiopia.

Thank you, Mr. President. Ethiopia welcomes the presentation of the draft resolution L15 and expresses its appreciation to the group members for their leadership and inclusive approach in bringing forward this important initiative. We reaffirm our strong support for the protection and promotion of human rights of older persons. As a country committed to inclusive development, Ethiopia recognizes the vital contributions of older persons to families, communities, and society at large, and believes their rights and dignity must be fully upheld. welcomes the resolution's proposal to renew the mandate of the independent expert on the enjoyment of all human rights by older persons, whose work remains essential in highlighting challenges, sharing good practices, and supporting States in strengthening protections. Ethiopia also notes with appreciation the reference to the establishment of the open-ended intergovernmental working group mandated to elaborate a draft internationally legal binding instrument on the human rights of older persons. This is a significant development toward disclosing the normative gaps and advancing the rights of older persons globally. Mr. President, Ethiopia supports the resolution L15 and expresses its hope that it will be adopted by consensus, continuing the Council's constructive and unified approach on this matter. I thank you.

Thank you.

We will give the floor to the distinguished representative of Chile.

Thank you very much, President. The draft resolution L.15, which is brought to the Human Rights Council, is an initiative of the highest importance or relevancy. Traditionally, it has had cross-cutting support in this Council. My country has supported with conviction since its beginnings. With co-sponsorship in Chile, as in many countries around the world, the low birth rate and the higher life expectancy has led to aging societies. Given this, we believe it is essential that we address the needs and challenges with a rights-based approach. For this reason, we support the important work undertaken by the independent expert on the human rights of older persons. We appreciate the core -- we thank the core group of Argentina, Brazil, and Slovenia, Philippines, and Gambia, and the Gambia for having presented this new version of the document. As with the new mandate, we hope that this be -- can be adopted by consensus. We should also like to avail ourselves of this opportunity to express our concern for the the slowing use of the harmonization of language between sustainable development and aging older people. These differences might seem minor, but for Chile, it is not irrelevant that there is no longer an explicit reference to the contribution made by older persons to the achievement of the 2030 agenda. Hence, Chile will continue to support this resolution and with firmness, as well as the mandate of the independent expert. However, we oppose any slippage in the recognition of the consensus language from the 2030 Agenda. We will continue to promote its inclusion in this forum. Thank you very much.

Thank you.

I give the floor to the distinguished representative of the Gambia.

Thank you, Mr. President. The Gambia is honored to be a member of this esteemed core group of Argentina, Brazil, Slovenia, and the Philippines on this very important resolution. We thank all delegations for their constructive engagement and the broad support extended to this initiative throughout the negotiations. Population aging is a global reality, with the number of people aged 60 and older projected to increase from 1.1 billion in 2023 to 2.1 billion by 2050. While Africa has a lower proportion of older persons compared to other regions, in absolute terms, our continent is home to some of the largest numbers of older persons. This substantial proportion of our populations are and must be entitled to enjoy their human rights on an equal footing with all other population groups. Therefore, this resolution reaffirms our collective commitment to promoting and protecting the human rights of older persons everywhere, recognising their invaluable contributions to our societies and the need to ensure that they live in dignity, equality and respect. The Gambia reaffirms its strong commitment to continue working at the national, regional and international levels to ensure that older persons everywhere live in dignity, equality and inclusion. We welcome the extension of the mandate of the Independent Expert on the enjoyment of all human rights by older persons, whose sterling work continues to advance understanding, visibility and action on this vital issue. We call on all members of this Council to support and adopt this resolution by consensus, as a strong expression of our shared commitment to uphold the rights, dignity and well-being of older persons in line with the UN principle of leaving no one behind. Thank you very much, Mr. President.

Thank you.

I give the floor to the distinguished representative of the Dominican Republic.

Thank you very much, President. The Dominican Republic thanks the core group made-up of Argentina, Brazil, the Gambia, Philippines, and Slovenia that are presenting this resolution on the human rights of older persons. Thank you for your leadership and constant commitment to this topic, which is of growing relevance around the world. We appreciate that the text reaffirms the principles enshrined in the UN Charter, the Universal Declaration of Human Rights, and the International Plan of Action on Aging. It underscores the need to ensure that no one remains behind in the implementation of the 2030 Agenda. We particularly hail the renewed mandate of the independent expert on the enjoyment of all human rights of older persons. The Dominican Republic wishes to reiterate its appreciation to Madame Claudia Mallat for the constructive and fruitful vision and visit undertaken in our country. This led for an open and enriching dialogue with the national authorities, civil society, and the public sector institutions. That visit led to The inclusion of the Dominican Republic into the Group of Friends of Older Persons allowed us to strengthen many policies and actions aimed at promoting and protecting the rights of older persons. We were able to reaffirm our country's commitment to inclusion, dignity, and equality in all stages of life. This shows the importance of the mandate. For the Dominican Republic, this resolution reflects a spirit of consensus and cooperation, promoting an inclusive approach that recognizes the contributions made by older persons in our societies and their active role in sustainable development and the need to ensure a life that is dignified, healthy, and free of discrimination for this group that is increasing on all continents. We invite all Member States to support this resolution as a commitment to equality, dignity, and a respect for human rights in all phases of life. I thank you kindly.

Thank you.

I give the floor to the distinguished representative of China.

China supports the statement by the Ambassador of Argentina in the introduction to the remarks. Population aging is a common and urgent issue facing the world today. The Chinese government attaches great importance to the issue of population aging and is implementing a national strategy to actively respond to it. China is committed to protecting the rights of older persons. In May this year, the Ministry of Civil Affairs, together with 18 departments, jointly issued guiding views on supporting the social participation of older persons and promoting their contribution to society. That is enhancing political participation, promoting the normal and long-term development of elderly volunteer services, improving the quality of social participation, and enhancing safeguards. In future, China will continue to work in this aspect. Together with relevant countries, China has submitted the resolution on building accessibility to promote enjoyment of human rights for all, to help groups including older persons better realize their various human rights. Mr. President, China notes that in many countries, older persons still face a lot of challenges in fully enjoying their human rights, including various forms of discrimination and inequality. The mandate of the independent expert is conducive to identifying and summarizing progresses, challenges, and best practices in protecting the rights of older persons across countries and promoting joint efforts by the international community to better protect the rights of older persons. In view of the above, China supports this draft resolution and joins in the consensus. Thank you.

Thank you.

I have been informed by the Secretariat that there are PBIs for this staff proposal. The PBIs amount to a total of $725,000. The amount of 711,300 has already been included under the program budget, and the amount of 13,900 will be added to the budget. for the relevant years. And I'll give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I don't see any requests. Is there a request for a vote? I see none. May I take it that draft proposal L15 may be adopted without a vote? It is so decided, with special thanks of my age group. Thank you very much. To which all of you will belong one day. The Council will now consider draft proposal L21, entitled The role of prevention in the promotion and protection of human rights, the rule of law and accountability. I give the floor to the distinguished representative of Ukraine to introduce the draft text.

Thank you, Mr. President. Mr. President, distinguished colleagues, Ukraine, on behalf of Australia, Hungary, Maldives, Morocco, Poland, and Uruguay, has the honor to present draft resolution L21 on the role of prevention in the promotion and protection of human rights, the rule of law, and accountability. This resolution was first initiated 15 years ago with the core idea that preventing human rights violations is far more effective than addressing their consequences after they occur. The resolution emphasizes the importance of taking proactive measures to prevent human rights abuses and of strengthening national mechanisms for human rights protection. It also reflects the commitments of states to countering aggression and promoting international stability, and highlights prevention as a central strategy to protect human rights, strengthen the rule of law, and ensure accountability for violations. While working on the renewal of this initiative, our effort was to complement rather than alter the text that was carefully negotiated three years ago in order to maintain consensus. The updated text advocates for more inclusive and effective prevention strategies, giving a central role to those most affected and supporting the long-term prevention of human rights violations. The draft also addresses modern threats to human rights posed by propaganda and disinformation, and therefore stresses the critical role of States in promoting supportive and enabling environments for preventing such threats. which can lead to serious violations of international law and negatively affect the enjoyment of human rights. Mindful of the liquidity crisis and following consultations with OHCHR, the Core Group included in the operative part only one request for a study that could examine more deeply the role of the rule of law and accountability in preventing and addressing conflict-related sexual violence. We thank all delegations that participated in informal consultations and shared their valuable views and proposals, which contributed to improving the text. We ask the members of this Council to support draft resolution L21, and we look forward to its adoption by consensus. I thank you.

Thank you.

I have been informed by the Secretariat that there are nine additional co-sponsors, and I now give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Morocco.

Thank you, Mr. President. Preventing human rights violations is an essential objective of the UN human rights system. Strengthening the rule of law and democracy and addressing root causes of human rights violations and establishing early warning systems are indeed far more impactful in protecting human rights than addressing human rights violations after they occur. Morocco has made this approach the cornerstone of its national legislation and policies in the field of human rights. The provisions of the Constitution of 2011 reflect this commitment through comprehensive human rights guarantees. As a member of the core group of the resolution, Morocco wishes to express its appreciation for the valuable efforts of Ukraine in drafting a consensual, balanced text that addresses emerging threats against human rights. Therefore, Morocco calls upon all Member States to adopt this resolution by consensus. Thank you, Mr. President.

Thank you.

I give the floor to the distinguished representative of Germany.

Group for this draft resolution. A stronger focus on preventing human rights violations before they occur is needed. Collectively, we all need to get better at promoting and protecting human rights before situations escalate into crisis. This requires cooperation and partnerships across the entire UN system and especially also between Geneva and New York. As this year's chair of the Peacebuilding Commission, Germany has made it a priority to strengthen these partnerships and build bridges between all relevant peace and security actors and the human rights actors. Keeping this resolution's focus on the rule of law and accountability, this new iteration adds some very valuable new elements. First, we welcome the inclusion of disinformation, propaganda and hate speech as threats to the enjoyment of human rights. These are early warning indicators that also often get overlooked when it comes to the prevention of human rights violations. The second point we'd like to make is that we also value the core group's efforts to take into account the liquidity crisis by consulting with OHR before including the request for a study by the High Commissioner as just mentioned by the Ambassador of Ukraine. We strongly support the proposed focus of this study on the role of rule of law and accountability in preventing and addressing conflict-related sexual violence. Therefore, we encourage all members of the Council to adopt the draft resolution L21 by consensus. Thank you.

Thank you.

I give the floor to the distinguished representative of Chile.

Thank you, President. Chile thanks the Core Group. Ukraine, Australia, Hungary, Maldives, Morocco, Poland, and Uruguay. Thank you for draft resolution L21, which reaffirms the importance of prevention and accountability as fundamental pillars for promoting and protecting human rights. Prevention is a central element in the mandate of the Human Rights Council, which calls upon us to address the structural causes of human rights violations. strengthening international cooperation in order to avoid these abuses before they occur. However, observing the current world, we note that this continues to be a challenge. We therefore believe that this resolution takes on an important relevance as it brings a concrete manner to proceed, strengthening the preventative pillar of the human rights architecture. We value that this has a victims-based approach in the prevention strategy. recognizing their meaningful participation as a guarantee for non-repetition. We also hail the inclusion of the new responsibilities for states, among them fighting disinformation and propaganda, promoting the implementation by companies of human rights impact based on UN guiding principles. We also appreciate the request from the High Commissioner's Office to draft a study on preventative mechanisms in the face of sexual violence in armed conflict. This will continue to strengthen access to justice, reparation, and accountability. Chile supports this resolution. It is consistent with our national priorities in prevention, justice, and rule of law, and we are certain that it will be adopted by consensus. Thank you very much.

Thank you.

Give the floor to the distinguished representative of Kenya.

Thank you, Mr. President. Kenya warmly thanks the members of the Core Group for their efforts in presenting this resolution, which aligns with Kenya's ongoing efforts to build resilient institutions and promote sustainable rights practices domestically and internationally. Kenya recognizes the emphasis on proactive measures, including addressing root causes of rights violations, strengthening national institutions, and fostering international cooperation. These principles resonate with Kenya's commitment to fostering inclusive governance, empowering civil society, and promoting gender equality, particularly in the lead-up to upcoming elections and national reforms. We welcome especially the resolution's recognition of the importance of partnerships and capacity building, which are essential for translating preventive strategies into tangible outcomes. And we welcome continued collaboration with UN systems. with regional bodies to bolster these efforts, recognizing that a collective, multidimensional approach enhances effective prevention. This involves empowering local communities, fostering inclusive dialogue, and ensuring resource availability to support long-term objectives. Kenya remains committed to the principles of non-selectivity, constructive dialogue, and respect for sovereignty, and encourages the Council to continue promoting a balanced approach that respects the sovereignty of Member States while firmly upholding universal human rights standards. In this regard, Kenya will join consensus on this resolution. Thank you.

I have been informed by the Secretariat that there are PBIs for this draft proposal. PBIs amount to a total of $80,000. This amount will need to be added to the budget. I will give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I do not see any requests for the floor. Is there a request for a vote? I see none. May I take it that draft proposal L21 may be adopted without a vote? It is so decided. Thank you. The Council will now consider draft proposal L24 Rev. 1 entitled "Human Rights and Indigenous Peoples". I give the floor to the distinguished representative of Mexico to introduce the draft text.

Thank you, President. I am pleased to present on behalf of Guatemala and Mexico, the draft resolution L24 Rev.1, entitled the Human Rights and Indigenous Peoples. Thank you to the Ambassador of Guatemala for being with me. The text that we're introducing today has the objective of reaffirming the importance of protecting and promoting the human rights of indigenous peoples, addressing the challenges they face globally. The draft resolution underscores anew the centrality of the UN Declaration on the Rights of Indigenous Persons and its positive influence on constitutional and legal reforms nationally and locally. It also underscores the work of the mechanism of experts and the Special Rapporteur on the Rights of Indigenous Peoples in the promotion of their rights. The draft resolution focused specifically on the issue of the participation of Indigenous peoples in the work of the Council. It is essential that we see ongoing discussions on this important topic based on the discussions held in 2024 and the report of the co-facilitators that was published in 2025. Further, the draft resolution calls upon the President of the Council to continue to organize the participation of Indigenous Peoples' representatives in the interactive dialogues with the Special Rapporteur and the Experts' Mechanism, also calling for their participation in the yearly roundtable on the rights of Indigenous Peoples. We are proud that the representatives of Indigenous Peoples have participated with their own voices in the interactive dialogues held during this session. We are even more pleased that in the year ahead they will be participating in the annual roundtable. This draft resolution also includes innovative items, such as the first reference to the rights of Indigenous persons in involuntary isolation, as well as the participation of Indigenous peoples in the development of AI. We also thank States and representatives of indigenous peoples that have actively and constructively participated in this process. The enriching dialogue between and among them during consultations is a proof of the utility of multilateralism and of this Council when it comes to bringing agreement and moving ahead in the protection of rights. For this reason, we call for the adoption of this draft resolution by consensus. Thank you kindly, Mr. President.

Thank you.

I have been informed by the Secretariat that there are nine additional co-sponsors, and I now give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Brazil.

Thank you, Mr. President. Brazil is pleased to support this resolution. which represents another step in strengthening the international community's commitment to the promotion and protection of the rights of Indigenous Peoples. We commend the core group for their efforts in conducting inclusive consultations and producing a balanced text. Brazil attaches particular importance to measures aimed at increasing the participation of Indigenous Peoples within the United Nations system. The text acknowledges past efforts and points to new opportunities to ensure that the indigenous representatives and institutions duly established by themselves can contribute directly to the work of the Human Rights Council and other relevant UN bodies. We see this as essential for achieving the ends of the United Nations Declaration on the Rights of Indigenous Peoples. We welcome, in particular, the encouragement to the United Nations Voluntary Fund for Indigenous Peoples to support the participation of Indigenous representatives and institutions in the Council's intersessional meetings. Brazil values the explicit reference to the need for interpretation for Indigenous representatives who do not speak any of the official UN languages. and to actual participation across the seven social cultural regions and their sub regions. These provisions contribute to ensuring diversity and inclusiveness in multilateral forums. Brazil also welcomes the recognition of indigenous peoples in voluntary isolation and initial contact, together with the reaffirmation of the principle of no contact as well as the reference to the recently approved Amazon Indigenous Peoples Mechanism within the Amazon Cooperation Treaty Organization, which strengthened dialogue between states and Indigenous peoples of the region. For these reasons, Brazil is pleased to support the adoption of this resolution by consensus. Thank you.

Thank you.

I give the floor to the distinguished representative of Spain.

Thank you very much, President. Spain thanks Mexico and Guatemala for the draft resolution. Since the adoption of the UN Declaration on the Rights of Indigenous Persons, this Council has been developing a significant normative corpus in strengthening the promotion and protection of human rights of indigenous persons, particularly through the work of the Special Rapporteur. and the expert mechanism, which has the full backing of my country. The substantive resolution presented by Guatemala and Mexico this year addresses, among other things, an essential item that is to say that the indigenous peoples must participate fully, effectively, and meaningfully in the UN fora in which matters are discussed that involve them. This participation must come free of all coercion We roundly reject coercion, and this council must remain vigilant thereon. We encourage ongoing conversations on methods for accreditation based on self-identification and self-determination, as called for by the Indigenous communities, so that they may be recognized as such and thus control their destiny. We agree with the promoters of this regarding the voluntary fund for Indigenous persons. Spain remains committed to this through constant and sustainable yearly contributions thereto. The support of indigenous organizations and their leaders, activists, and representatives, specifically, and in particular, women and girls of indigenous groups, is a focus of Spanish cooperation in their efforts to support these matters. This resolution With this resolution, we reaffirm our commitment to multilateralism focused on populations that this must all serve. Spain fully backs the draft resolution L24 Rev. 1, and we call for its adoption by consensus. I thank you kindly.

Thank you.

I give the floor to the distinguished representative of Cuba.

President, We thank the delegations of Mexico and Guatemala. Thank you for presenting draft resolution 24 Rev. 1. Thank you for your efforts to bear in mind the positions of all delegations. Cuba firmly supports the defense of recognition of and effective and full implementation of the rights of indigenous persons in step with the UN Declaration on the Rights of Indigenous Peoples. Its adoption in 2007 was a historic step forward in the fight, a historic victory for these peoples to uphold their ancestral rights. They have the full right to their full development, as all cultures do, in the protection of their cultural practices inherent to their identity. It is clear and undeniable there's spiritual and historical wealth provided by these peoples to have the right to have their own cultures, institutions, and traditions without discrimination. The Cuban delegation recognizes and hails the progress made in the Council when it comes to ensuring the participation of representatives of indigenous peoples in the dialogues with the Special Rapporteur and the Experts Mechanism on the Rights of Indigenous Persons, EMREP. This participation as established in paragraph 25 of the draft resolution, has an exceptional nature based on the Declaration of the Rights of Indigenous Peoples, and it is not a precedent. For the reasons expressed, Cuba supports this draft resolution, L24 Rev.1. We hope that it can be adopted by consensus. Thank you very much, Mr. President.

Thank you.

I give the floor to the distinguished representative of Costa Rica.

Thank you, President. Costa Rica thanks the delegations of Mexico and Guatemala. Thank you for having presented this draft resolution. This was the subject of intense negotiation, and it was successfully managed by the promoters towards a solid and balanced text. The UN Declaration on the Rights of Indigenous Peoples is a universal framework that guides the actions of states, civil society, and the international community toward the full enjoyment of collective and individual rights of indigenous persons. It continues to be a fundamental reference point when it comes to making progress in building more inclusive societies. to ensure that the draft resolution reaffirmed the importance of the full and effective participation of the representatives of Indigenous communities or peoples in decision-making in the United Nations, and also as a recognition of the contribution of Indigenous peoples in the areas of biodiversity and climate change and environmental pollution. the indigenous peoples have played an essential role, an essential role in the promotion of a sustainable, clean, and healthy environment. Costa Rica also wishes to underscore the values of the text provisions that underscore the importance of indigenous women and girls, which face multiple and overlapping forms of discrimination. They play important leadership roles in all levels of community. We also believe that it is essential that we support the indigenous leaders and rights defenders, ensuring that they can undertake their rights safely and freely in an environment that is conducive to the defense of human rights. For the aforementioned reasons, Costa Rica reiterates its support to this draft L24 Rev.1. We encourage that it be adopted without a vote. Thank you very much.

Thank you.

I give the floor to the distinguished representative of Bolivia.

Thank you, President. We wish to express sincere appreciation to the delegations of Mexico and Guatemala for the work undertaken and the commitment shown and the efficient facilitation that's allowed for this L24 Rev 1 to be concluded. Thank you also to the delegations that actively participated in the negotiations. We recognize that Indigenous Peoples carry ancestral wisdom. It is invaluable and closely tied to the protection of environment, cultural diversity, and sustainable development. Their full and effective participation in the adoption of decisions is not a concession; it is a fundamental right. However, there are still remaining significant challenges that remain. Many Indigenous peoples continue to face discrimination, poverty, expulsion from their lands, and violence. This is worsened by the effects of climate change and the loss of biodiversity. This resolution underscores the urgency of adopting concrete measures that ensure their well-being, security, and their right to decide on their own development. We fully support the inclusion of the topic, the Convention for the Protection of Global Cultural and Natural Heritage, as well as the mentions of numerous areas of progress, such as the treaties on intellectual properties and traditional knowledge, as well as the mechanism on the Amazon. in the area of Amazon cooperation. We particularly value that this recognizes the essential role of women and indigenous women and girls in the preservation of languages, knowledge, and traditions, promoting their participation on an equal footing in all areas. Further, we wish to underscore the importance given to the International Decade for Indigenous Languages. And for those indigenous communities in voluntary isolation. This reflects a commitment, that is to say the resolution, a commitment to the inclusion of indigenous peoples in international decision-making venues. This is essential when it comes to the promotion and protection of their rights. Cooperation between and among States and international organizations and indigenous peoples is essential when it comes to consolidating an international system that is more inclusive, fair, and representative. Bolivia supports, co-sponsors, and calls for the adoption of this document by consensus. And thank you.

Thank you.

I have been informed that our PPIs for this draft proposal, the PPIs amount to $291,100. The amount of $247,900 has already been included under the program budget, and the amount of $43,200 will need to be added to that budget. I now give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I would like to inform the Council that Colombia withdrew its co-sponsorship for this draft proposal, as reflected in e-delegate, and can therefore intervene. I give the floor to the distinguished representative of Colombia.

Thank you, President. Colombia thanks the delegations of Mexico and Guatemala for coordinating broad and transparent consultations to bring to this Council L24/Rev.1. Indigenous peoples are the wise guardians of Mother Nature and coordination on the world. In times of climate change, their message of peace and nature is more relevant and present than ever. It is the goal of Colombia to deepen autonomy, participation, and the enjoyment of collective rights of Indigenous persons on all levels and in all scenarios. It is for this reason that we identify with this draft resolution, which seeks to generate consensus for a more active and representative participation of Indigenous peoples in the Human Rights Council mechanisms. with a different status than that of civil society organizations. We wish to underscore that this draft resolution calls attention to the peoples in involuntary isolation and first contacts is regarding first contact situations. There is the issue of climate change, the loss of biodiversity, and also pollution. Further, we are pleased that the draft resolution values the contributions made by the Amazon Cooperation Body. During the presidential meeting held in August of last year in Colombia, one of the primary results of that summit was ongoing dialogues in the Amazon to ensure the participation of Indigenous peoples in the decision-making of the aforementioned body. Progress must be made in the discussion on accreditation for indigenous groups with the principles of self-identification, autonomy, non-discrimination, self-determination, and transparency, as well as accountability. Our country offers its decided backing to this initiative. For this reason, Colombia will vote in favor of draft resolution L.24 Rev.1. should it be brought to a vote, and we cordially invite members of the Council to follow suit. Thank you very much.

Thank you.

I give the floor to the distinguished representative of Algeria.

Thank you, President. Algeria would like to thank the core group consisting of Mexico and Guatemala for holding a transparent, constructive process of negotiation into the draft resolution. as an indigenous nation marked by a complex cycle of colonialism over more than two millennia considers its linguistic and cultural diversity as key to strengthening social cohesion and a sense of belonging. Since our independence in 1962, our choice has been to embrace this diversity while recognizing Amazighness, Arabness, and Islam as essential pillars of a shared and rich identity. None of these is downplayed or trampled, they together form all of Algerian identity. Regarding L24 Rev. 1, we express our sincere appreciation to the delegations of Guatemala and Mexico for listening carefully, for being understanding and flexible throughout the negotiation process. We especially appreciated the quality of discussions. They were very constructive, not only with the creators of the text, but with all interested delegations and with the representatives of indigenous peoples. While several of our concerns have been partially taken into account in the text, we would like to underscore the following. First, the issue of indigenous peoples' rights must be dealt with in the context that is specific to each state. Second, discussions on participation of indigenous peoples must be in line with the provisions of the UN Declaration on the Rights of Indigenous Peoples, duly taking into account the concerns expressed by States. Article 46 of this declaration, in our view, is a fundamental provision. Third, The principles for accreditation in the resolution are neither fixed nor definitively approved. They must be considered as a basis for ongoing discussions, and they may be updated and changed in light of future discussions. President, while reiterating our thanks to the core group for this draft resolution, Algeria would like to reaffirm its firm support for the rights of Indigenous Peoples, and we underscore that recommendations to preserve mechanisms dedicated to them from being misused for political purposes and destabilization is important. My delegation joins the consensus around this resolution. Thank you.

I give the floor to the distinguished representative of Japan.

Thank you, Mr. President. Japan expresses appreciation to the efforts of the core group behind the draft resolution L24.1, namely Mexico and Guatemala, for the commitment to the protection and promotion of human rights related to indigenous people and convening the informal consultations. Japan would like to emphasize that following the adoption of the United Nations Declaration on the Rights of Indigenous People by General Assembly in 2007, we have been implementing comprehensive policies for the promotion and protection of the rights of the Ainu people, the indigenous people of Japan. Based on the Ainu Policy Promotion Act, enacted in 2019, these policies include measures for cultural promotion, welfare, and regional development. Through the Council for Ainu Policy Promotion, we have been working to protect and respect the human rights of the Ainu people by reflecting their views in our policy making. In line with this approach, Japan has traditionally joined consensus on similar resolutions supporting their general objectives. At the Human Rights Council, opportunities for indigenous people to participate are already provided. including during interactive dialogues and mechanisms such as MRIP. In light of exchanges during intersessional meetings and informal consultations on this draft resolution, Japan understands that there are ongoing discussions on further expanding such participation from the perspective of inclusivity. We believe that continued dialogue among governments, indigenous people, and other stakeholders is needed to determine the most appropriate modalities for ensuring such participation. In this regard, Japan considers that careful consideration is required when examining a possible accreditation system for representation of indigenous people and their organizations. This includes examining its relationship with existing mechanisms and ensuring a balanced approach with other stakeholders. Therefore, we believe that discussions must continue not only on whether such a system should be established, but also, if it were to be so, on ensuring that accreditation and criteria are transparent, accountable, and include objective elements to enable orderly and fair implementation. This aligns with the conclusion and recommendations contained in the joint report of intersessional meetings. Japan stands ready to contribute constructively on these discussions going forward. On this basis, Japan will join the consensus on this draft resolution. I thank you, Mr. President.

Thank you.

I don't see Any other requests for the floor? Is there a request for a vote? I see none. May I take it that draft proposal L24-REF1 may be adopted without a vote? It is so decided.

Thank you.

The Council will now consider draft proposal L27-REF1 entitled Promoting and Protecting Economic, Social and Cultural Rights. within the context of addressing inequalities. I give the floor to the distinguished representative of China to introduce the draft text.

Mr. President, on behalf of the cross-regional core group composed of Bolivia, Egypt, Pakistan, South Africa, and China, as well as the co-sponsors, I have the honor to introduce amended draft resolution L27 Rev.1. The Vienna Declaration asserted the principles of universality, indivisibility, and interdependence of all human rights. Promoting these rights in balanced way is an important principle in the Vienna Declaration, however, ESC rights have long been undervalued. Global challenges such as resource constraints have exacerbated the situation, highlighting disparities at the international and national levels, which seriously impede the realization of human rights for all and the achievement of the Sustainable Development Goals. This year marks the 80th anniversary of the UN and the 30th anniversary of the adoption of the Beijing Declaration and Platform for Action. At this important historic juncture, the core group has once again put forward this draft resolution, aimed at bridging conceptual differences and maintaining an action-oriented approach. The draft resolution addresses the current challenges of resource gaps and growing inequalities in the realization of ESC rights. It calls for strengthened multilateralism and international cooperation, particularly taking into account the needs of developing and least developed countries. It proposes panel discussions and interactive dialogues on the progress, challenges and opportunities in advancing ESC rights. in the context of addressing inequalities to strengthen the exchange of experiences and mutual learning. It welcomes the establishment of ESCR Knowledge Hub and the online platform and calls for ensuring adequate resources to continue supporting the work of the OHCHR in strengthening its efforts to better provide technical assistance and capacity building. Guided by the principles of openness and transparency, the core group has held four rounds of informal consultations, engaged in numerous bilateral discussions, and maintained close communication with the OHCHR. We have accommodated suggestions from various parties to the greatest extent possible, and the current draft resolution reflects the consensus among all parties to the maximum. We appreciate wholeheartedly the efforts and contributions made by the Co-Chair Group and all parties involved.

19 additional co-sponsors. I now give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Ethiopia.

Thank you, Mr. President. We thank the core group members of China, Bolivia, Egypt, Pakistan, and South Africa for their leadership in tabling this important resolution. Ethiopia is pleased to have co-sponsored the resolution and expresses its firm support for its adoption by consensus. Ethiopia believes that the full realization of economic, social, and cultural rights without discrimination is central to building just, equitable, and resilient societies. These rights are not optional. They are fundamental to dignity, development and peace. This year's resolution is especially timely. The world continues to confront overlapping global crises, from protracted conflicts and economic shocks to climate change and resource constraints, which have exacerbated structural inequalities and undermined social cohesion. Against this backdrop, our shared commitment to leaving no one behind must be reaffirmed with concrete action. Ethiopia welcomes the recognition in the resolution of the importance of international cooperation, capacity building, and the establishment of the Knowledge Hub as a practical step toward strengthening national efforts. We particularly appreciate the resolution's focus on addressing root causes of inequality, including extreme poverty, homelessness, and limited access to health, education, and social protection. Mr. President, Ethiopia is undertaking comprehensive reforms aimed at improving the delivery of economic and social services, expanding access to healthcare and education, and implementing inclusive development strategies that prioritize rural communities and vulnerable groups. We are also enhancing our national human rights institutions and systems to ensure alignment with our regional and international obligations. In conclusion, Ethiopia reaffirms its strong commitment to the promotion and protection of economic, social and cultural rights, essential pillars of sustainable development, equality and social justice. We therefore call upon all members of this Council to support the adoption of this resolution by consensus. I thank you, Mr. President.

Thank you.

I give the floor to the distinguished representative of Cuba.

President, we thank the delegations of China, Bolivia, Egypt, Pakistan, and South Africa. Thank you for presenting draft resolution L27, rev. 1. This is a positive and concrete contribution to the promotion and protection of the economic, social, and cultural rights. We appreciate progress made by the Office of the High Commissioner in addressing this topic. Much remains to be done, however. We reiterate the call to increase practical actions in this regard. In the context of international order that is unfair and that perpetuates inequalities, it is essential that we place greater emphasis on the enjoyment of economic, social, and cultural rights. They must have the same level of priority as is given civil and political rights. Cuba reiterates its firm support for the principles of universality, progressivity, non-politization, interdependence, and non-selectivity of human rights. We hail the fact that the draft resolution recognizes the importance of international cooperation, technical assistance, technology transfer, and access to additional and predictable financing. These are catalyzing elements for leveraging economic and social and cultural rights in our developing countries. We agree further that the reform of the international financial architecture would contribute to the implementation of the 2030 agenda and to the enjoyment of all human rights for all. For the reasons explained, Cuba supports draft resolution L.27 Rev.1, and we hope that it can be adopted by consensus. Thank you very much, Mr. President.

Thank you.

I give the floor to the distinguished representative of Cyprus.

Thank you, Mr. President. I have the honor to speak on behalf of the EU member states that are members of the Human Rights Council. This general comment has been agreed by the EU as a whole. The realization of human rights, including economic, social, and cultural rights, is a fundamental pillar of the EU's values and policies in the promotion of dignity and sustainable development for all. The EU and its member states, as the world's the largest providers of official development assistance, contribute substantially to advancing the realization of these rights globally. We have also been active in this area through a number of resolutions, most notably the omnibus resolution on the question of the realization of economic, social and cultural rights, adopted by consensus. In the current context of Human Rights Council efficiency and rationalization efforts, due regard must be given to pre-existing initiatives in this field, avoiding inefficiencies and duplications. We recognize the enormity of multiple and intersecting challenges, including growing poverty, inequalities and discrimination. We reiterate the importance of a human rights-based approach in addressing inequalities by placing the individual as a central subject of human rights, recognizing every person as a rights holder and states as duty bearers. All human rights are universal, indivisible, interrelated and interdependent. At the same time, we also recognize that the international financial architecture must continuously adapt to changing global realities, align with sustainable development, and respond to the needs, evolving challenges, and vulnerabilities facing all countries, especially developing countries. Mr. President, the EU thanks the Core Group for engaging constructively throughout the renegotiation process to pursue a consensual outcome on the important topic of economic, social, and cultural rights. We appreciate the efforts made to address our We are encouraged by these positive developments as we continue to resolutely support upholding all human rights, including economic, social and cultural rights. The objective of this resolution is to reinforce the ability of the OHCHR to support States in fulfilling their economic, social and cultural rights obligations. We welcome that the revised resolution enables the Office to support States with its guidance and assistance. With these words, the EU joins consensus on this draft resolution. Thank you.

Thank you.

For our country, the enjoyment of economic, social, and cultural rights is essential, are essential, in movement toward societies that are more fair and equal. For this reason, we have implemented programs and public policies that aim at ensuring these rights. They are focused in particular on those that find themselves in vulnerable situations. We have thus been able to reduce poverty by some 12.4% between 2018 and 2024. We have been able to thus increase access to social security, housing, basic services, food, and nutritional food at that. We also appreciate those promoting this draft resolution, L27 Rev.1. Thank you for your openness to listening to the concerns of other delegations around this text during informal consultations. Thank you also for the flexibility shown in making necessary changes. Thank you.

I give the floor to the distinguished representative of the Gambia.

I give the floor to the distinguished representative of Kenya.

Thank you, Mr. President. My delegation thanks the Core Group in their effort to present this draft that we believe reaffirms the essential place of economic, social, and cultural rights within the broader human rights framework. align with the principles underscored by this Council that these rights are universal, indivisible, interdependent, and interrelated, and that their realization is pivotal to human dignity, equality, and sustainable development. Kenya recognizes the profound importance of advancing these rights as foundational for lifting our citizens out of poverty, reducing inequalities, and building inclusive societies. These rights are not mere aspirational goals; they are legally binding obligations that States must realize without discrimination, especially for marginalized and vulnerable groups. It is in this spirit that Kenya continues to prioritize investment in public health, education, social protection, decent housing, decent work, water and sanitation, sectors that form the bedrock for the effective enjoyment of ESCR within our national context. We commend the emphasis placed on addressing inequalities and discrimination as root causes that obstruct the fulfillment of these rights. In our pursuit of Agenda 2030, Kenya is steadfast in leaving no one behind, ensuring equitable access to essential services and opportunities. We also welcome efforts to strengthen international cooperation, capacity building, and technical assistance to states, recognizing that the realization of ESCR is a shared global duty requiring solidarity and partnership. We especially welcome the proposal to convene a panel discussion with gender balance and equitable geographic representation on progress, challenges and opportunities in promoting and protecting economic, social and cultural rights within the context of addressing inequalities, including the impact of the funding and liquidity constraints on the work of the Office of the High Commissioner. Kenya calls on continued constructive engagement to uphold these rights and calls all States to join hands in translating commitments into tangible improvements in people's lives. In this regard, my delegation looks forward to joining consensus on this matter. Thank you.

Thank you.

I give the floor to the distinguished representative of South Africa.

Mr. President, South Africa is honored to deliver general remarks in strong support of draft resolution L.27. We wish to thank China for their leadership and other members of the core group for this important initiative. This resolution speaks directly to the lived realities of millions of people around the world, growing disparities in wealth, persistent poverty, and structural inequalities that continue to deny people their most basic human rights. For South Africa, the promotion of economic, social, and cultural rights is not an aspiration. It is a foundation for justice, dignity, and lasting peace. Mr. President, the effective realization of these rights is central to achieving the SDGs. Economic, social, and cultural rights, including the rights to education, health, work, housing, food, and social protection, are indispensable to building inclusive and resilient societies. Their fulfillment is not only a legal obligation under international human rights law, but also a moral imperative that binds us in our common humanity. Mr. President, the resolution's focus on addressing discrimination and inequalities in all their forms is particularly welcome. South Africa underscores the centrality of gender equality and the promotion of sexual and reproductive health and rights. Women and girls must have full and equal access to healthcare, education and economic opportunities, free from stigma, violence and exclusion. Empowering women and ensuring their bodily autonomy are not only matters of human rights, they are essential drivers of sustainable development and social cohesion. We further welcome the resolution's emphasis on social protection systems, equitable access to healthcare, and the strengthening of international cooperation and solidarity. These are vital tools to combat inequality, reduce vulnerability, and promote inclusive growth. In this regard, we echo the call by President Cyril Ramaphosa for a world order that reflects fairness, inclusivity, and respect for the dignity and equality of all peoples. Mr. President, in supporting draft resolution L27, let us remember, rights that are denied to the poor, to women, and to the marginalized are rights denied to humanity as a whole. This Council must remain steadfast in ensuring that economic, social, and cultural rights are not distant promises, but tangible realities, so that we truly leave no one behind. I thank you.

Thank you.

I give the floor to the distinguished representative of Sudan.

Thank you, Mr. President. At the outset, we thank the core group comprising China, Bolivia, Egypt, Pakistan, South Africa for presenting the draft resolution. This draft resolution before you stresses the interdependability between human rights and the fact that they are mutually reinforcing. It also stresses the central role of economic, social, and cultural rights in the human rights system. This draft resolution renews its commitment to the sustainable development agenda, especially through references to address gaps between and among states, and stressing the principle of leaving no one behind. It's also important, as mentioned, to address poverty. The draft resolutions referred to reasons for the underdevelopment of states, including UCMs, which increase the suffering of countries that already are undergoing socioeconomic difficulties. It also stressed the responsibility of states to promote and protect human rights and advance prosperity and welfare of their own people and responding to their development needs. We support the draft resolution, and we call for adopting this resolution by consensus. Thank you, Mr. President.

Thank you.

Give the floor to the distinguished representative of Bolivia.

President, we thank the distinguished delegation of the People's Republic of China for this presentation and leadership for draft of the draft resolution, we have been part of these efforts. We reaffirm our commitment to the promotion and protection of economic, social, and cultural rights, essential pillars to the right to development and a foundation for a more fair and equal society. At the same time, we recognize that all human rights are universal, interdependent, and indivisible. Inequality and discrimination continue to be serious obstacles to the full enjoyment of human rights. In step with the principle of not leaving anyone behind of the 2030 agenda, we reaffirm our commitment to SDG 10, which seeks to reduce inequalities, promoting inclusion on all levels. At the same time, we underscore the need to bolster international cooperation and multilateralism. They are essential in supporting national development efforts. In order to ensure equitable development, we also need a reform of the international financial system which better represents and hears the voice of developing countries. We need to see greater investment in decent work, housing, health care, education as foundations for a dignified life. Poverty eradication must continue to be a global priority. We underscore also the value of education and training in human rights. These are motors of change that can help build more equal societies that serve solidarity and are inclusive. It is only through a full respect for economic, social, and cultural rights that we will be able to build a future in which equality will be a tangible reality for all people in all places. We held a mention of the the mention of the 30 years of Beijing Declaration Platform of Action, as well as the Center for Knowledge on Economic, Social, and Cultural Rights, dedicated to technical assistance and capacity building. As members of the core group, we also call for the adoption of this by consensus. I thank you.

Thank you.

I give the floor to the distinguished representative of the Dominican Republic.

President, the Dominican Republic. Thanks, the core group, China, Bolivia, Egypt, Pakistan, and South Africa. Thank you for presenting this resolution, which draft resolution, which reflects the initial thoughts of 54/2 on structural inequalities in the structures after the pandemic and the impact on economic, social, on the enjoyment of economic, social, and cultural rights. We value that the text reaffirms the interdependency of equality and non-discrimination, as well as the right to development. It recognizes that the persistent gaps limit the full enjoyment of these rights in developing countries and in the least developed countries. We wish to thus underscore the importance of international cooperation, technical assistance, and capacity building. We also wish to underscore the need to strengthen the role and the resources in the High Commissioner's Office for Human Rights, particularly in the regional offices. This would allow for financing that is sustainable and that can respond to the challenges that arise from the liquidity crises. With this spirit, we urge States to support this resolution. It offers a useful framework for ongoing evaluation of inequalities in economic, social and cultural rights. I thank you kindly.

Thank you.

I give the floor to the distinguished representative of Kyrgyzstan.

Thank you, Mr. President.

Kyrgyzstan welcomes the draft resolution L27 Rev.1, which addresses one of the most pressing global challenges, reducing inequalities through the promotion and protection of economic, social and cultural rights. We believe that this text makes an important step toward advancing global development, equity, and support sustainable international order. This is why my delegation was pleased to co-sponsor this forward-looking document. Kyrgyzstan sincerely hopes that this important initiative will enjoy the broadest possible support and will be adopted by consensus.

Thank you.

Thank you.

I have been informed by the Secretariat that there are PBIs for this draft proposal. The PBIs amount to a total of $2,138,300. This amount will need to be added to the budget. I now give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I give the floor to the distinguished representative of Japan.

Thank you, Mr. President. We thank the Core Group for its efforts in preparing this resolution. Economic, social and cultural rights are important elements of human rights, together with civil and political rights. The first draft of L27 included several paragraphs focusing only on development, not economic, social and cultural rights. We understand that development-related issues are, of course, very important topics for many countries. However, since L27 is a Human Rights Council resolution, in our view, it should focus on human

rights as opposed to on development itself.

From this standpoint, Japan has engaged in the discussions at the informal consultations and bilateral discussions with the core group. As a result, the core group accepted not a few of our suggested modifications, seriously considering our concerns over the original text, and therefore, although there remain some parts that we wish to continue to discuss, recognizing the importance of economic, social, and cultural rights. and considering the sincere efforts and flexibility shown by the core group during the consultation so far, we have decided to join consensus. We look forward to continuing constructive discussion on those parts that we could not concur with this time when they appear in the future Human Rights Council resolutions.

I thank you. Thank you.

I don't see any other request for the floor. Is there a request for a vote? I see none. May I take it that draft proposal L27/1 may be adopted without a vote? It is so decided. Thank you. We will continue considering proposals under item 3 at a later stage and turn now to item 4. The Council will now consider draft proposal L13 entitled Situation of human rights in Burundi. I give the floor to the distinguished representative of Denmark on behalf of the EU to introduce the draft text.

Thank you, Mr. President. On behalf of the European Union, I have the honour to present draft resolution L13 entitled Situation of human rights in Burundi. We thank all co-sponsors, delegations and civil society for their constructive engagement throughout the negotiations. The Special Rapporteur informed this Council about the worrying situation of human rights in Burundi, where violations and abuses still take place: arbitrary arrests and detention, enforced disappearances, including of political opponents; alleged acts of torture and other cruel, inhuman or degrading treatment or punishment, as well as severe restrictions to the rights to freedom of expression, of peaceful assembly and of association. Adding to this, a group of eight special procedures expressed their deep concern about the increase in serious human rights violations in Burundi, particularly in the context of the electoral period which started this year and will culminate with the presidential elections in 2027. The text before you reflects these concerns. But let me underline that this balanced draft resolution gives credit to Burundi for its efforts to advance human rights where those are documented. In that respect, the resolution welcomes the submission of Burundi's report to the Committee on the Elimination of Racial Discrimination, as well as progress made with regard to regional and international participation. Another important element of this text is the structural challenges Burundi faces in relation to the respect, protection and fulfilment of economic, social and cultural rights, particularly the rights to education, to health and to adequate food. In that regard, the EU reiterates its engagement to support sustainable development in Burundi. Unfortunately, Burundi persists in refusing to engage with the Special Rapporteur and other mechanisms such as the ICC. We also lament the lack of meaningful cooperation with the OHCHR. The EU therefore encourages Burundi to grant access to the country to the Special Rapporteur and to consider reopening the OHCHR local office. Mr. President, in these circumstances, we call on this Council to renew the mandate of the Special Rapporteur for another year. This will ensure continued and independent monitoring of the human rights situation in Burundi. The European Union will continue to keep an open door for a constructive dialogue with Burundi in order to find a consensual way out. For these reasons, we call upon all members of this Council to adopt this resolution. I thank you.

Thank you.

I have been informed by the Secretariat that there are three additional co-sponsors, and I give the floor now to members of the Council who wish to make general comments. I give the floor to the distinguished representative of Albania.

Thank you, Mr. President. Albania thanks to the European Union for presenting resolution L13. As the Special Rapporteur on Burundi highlighted last month, the situation of human rights has unfortunately not improved and remains alarming. We appreciate that the resolution presented by the European Union remains balanced and keeps a rather neutral tone, while drawing from the latest reports and communique from the UN Special procedure to update the text. We all come the fact that the 2025 elections were largely peaceful, but we also echo the concern of special procedures and this resolution about the condition in which these were held, with reports of forced registration of voters, forced collective payment of funds, threats for those who refuse a closure of the civic space, and arbitrary arrest of journalists. The protection for human defenders, activists, civil society, and journalists, all of whom are subject to growing human rights violations, is an important aspect of free and fair elections. We also support the fact that the resolution gives more space to the issue of economic, social, and cultural rights, something that is particularly relevant in the case of Burundi. Finally, we support the adoption of this important resolution. Thank you, Mr. President.

Thank you.

I give the floor to the distinguished representative of Iceland.

Mr. President, Iceland thanks the European Union and its Member States for presenting this resolution. The Special Rapporteur produces valuable reporting and we support the renewal of the mandate, especially given the context where serious human rights violations and abuses continue to persist in Burundi. Iceland echoes the recent call from the group of the eight Special Procedure mandate holders to ensure that victims of torture and women and girls who are survivors of sexual and gender-based violence have access to appropriate care, including free comprehensive sexual and reproductive health services and psychological support. We remain deeply concerned about the SR findings that women continue to face structural discrimination in access to land, employment and justice, and that the enterprise violence, including domestic violence, occurs frequently and is underreported. Iceland appreciates that the text of the resolution refers to the electoral period that runs until 2027, particularly in a context where the civic space continues to shrink, journalists cannot do their work in full independence, human rights defenders are silenced, and any dissonant voice is squashed. We remain concerned about the continued denial of access of the Special Rapporteur to the country and lack of meaningful cooperation of the country concerned with the OHCHR. Iceland therefore supports resolution L.13 and calls on the rest of the Council to do the same. I thank you.

Thank you.

I give the floor to the distinguished representative of North Macedonia.

Thank you, Mr. President. We thank the European Union for presenting resolution L13. We reiterate our support for the mandate of the Special Rapporteur on the situation of human rights in Burundi. Four years ago, the Human Rights Council decided to end the mandate of the Commission of Inquiry, which was set up to investigate the extremely grave human rights violations and abuses committed during the 2015 Burundian crisis. At the time, despite some positive signals, the situation was still deeply concerning, leading to the creation of the mandate of the Special Rapporteur. Today, unfortunately, those deep concerns remain, while many of the recommendations expressed by the Commission of Inquiry and the Special Rapporteur over the years remain unanswered. The letter makes the need for independent monitoring of the situation of human rights in Burundi even more relevant. We welcome the inclusion in the text of a reference to the rights of children. As the latest report of the Special Rapporteur underlines, the situation of children in Burundi remains troubling and is characterized by structural challenges and recurring humanitarian crises that affect them disproportionately. We also appreciate the focus of the resolution on the electoral context as well as the situation of the civic space and human rights defenders, whose safety should be guaranteed. Mr. President, we support the adoption of this important resolution, and we call Council members to do the same. I thank you.

Thank you.

We will now hear from the country concerned. I give the floor to the distinguished representative of Burundi.

Thank you, President. Last year, the European Union initiated this hostile mechanism to my country, and convinced the other member states of the need to extend by one year the mandate of the Special Rapporteur on Burundi. It appeared that the conditions had been met to begin a procedure to observe my country in light of the upcoming electoral period in 2025. We have just concluded administrative and local elections successfully. This saw high participation in a secure and peaceful environment. as recognized by all international observers who responded to the government's call without restrictions to assist in the electoral process. It is now somewhat outrageous to hear the penholders of this resolution to provide providing intentionally misleading information even though the elections were held without any violence and my country remains closely observed, including up to the elections in 2027. This shows that the resolution brought before the Council is deliberately ill-intended and meant to maintain pressure on Burundi in continuation of efforts since 2015. In spite of the strong republican institutions in my country, this has become a divisive tool to place labels on our communities. is discriminatory, using irresponsible terms with an ethnic bent. This seriously calls into question the purpose of this council. This is now a propaganda mechanism. It is detrimental to the voice of the people and dehumanizes the entire youth and disputes the legitimacy of our institutions. This mandate is far from serving the promotion and protection of human rights as intended because it pits ethnicities against each other and promotes mistrust and suspicion between communities in a context of a people that is recovering and is drawing on its ancestral values. And this is encouraged by the former colonizer that previously measured our noses and skulls This seems to be a continuation of all of this, this mandate, and continues it into the modern era, that is. We find a mechanism that is institutionally groundless and which stains the credibility of this Council. My country cannot tolerate any ethnic discourse being used in the United Nations for such a purpose and is therefore opposed to the renewal of the mandate of the Special Rapporteur and calls on all to go over together. Thank you.

Informed by the secretariat that there are PBIs for this draft proposal. The PBI amounts to a total of $535,900. This amount has already been included under the program budget for the relevant years. I now give the floor to members of the Council who wish to make explanations of votes before the vote on the draft proposal. I don't see any request for the floor. At the request of the delegation of Burundi, the Council will now proceed to a recorded vote on draft proposal L.13. I ask the Secretariat to open the voting machine and request all delegations to register their vote. I also request all delegations to check whether their vote is accurately reflected on the screen. If so, I ask the Secretariat to close the voting machine. The voting is now closed. The result of the recorded votes are as follows: 23 in favour, 9 against, 15 abstentions. Draft proposal L.13 is therefore adopted. Copies of the results of the votes will shortly be uploaded on Extranet. We will now consider the draft decision L.62 under agenda item 6, entitled Non-cooperation of a State under review with the universal periodic review mechanism. China has a

Uh, yes, thank you, President.

We hope to, uh, make a statement on the explanation of vote after the vote.

Sorry.

of vote after the vote are only when the item is finished. We have not finished item four yet. There is more proposals to be considered under item four. Once all proposals have been dealt with, there will be an opportunity to make a statement after the vote. Thank you, China. So I restart. We will now consider the draft position L62 under agenda item 6, entitled "Non-cooperation of a State under review with the Universal Periodic Review mechanism". As agreed by the Bureau, this draft decision is in response to the non-cooperation of Nicaragua for the adoption of the outcome of its review with the UPR mechanism. The draft proposal calls upon the State under review to resume its cooperation with the UPR mechanism, while requesting the President to continue to take appropriate steps to urge cooperation. The decision would postpone the consideration of the outcome of the UPR of Nicaragua until the 63rd session of the Council, while leaving open the possibility for it to be scheduled sooner. Are there any members of the Council wishing to make comments at this stage? I see none. We would now hear from the concerned country, but I note that Nicaragua is not present in the room. I have been informed by the Secretariat that there are no PDI's for this draft proposal, and I understand that L62 enjoys the support of all in this room. With this, I take it that draft decision. I see the representative of Cuba.

President, the Cuban delegation reiterates its commitment to the UPR. It is not a perfect mechanism, but it has shown itself to be useful and has shown positive results on the ground. Its operations are based on a respectful dialogue between equals and with consent and cooperation that is constructed between and among States. The draft decision L/62 is based on the -- on WTO/1 adopted in 2003. However, there are notable differences between the two processes. It is positive and fair that this draft recognized the participation of Nicaragua in the interactive dialogue of the UPR and the presentation of its national report. This mention contributes to factually reflecting the manner in which the process for Nicaragua has unfolded and the primary intention of that country to cooperate constructively with the UPR. The reality is that despite the proven willingness to participate against the Caragua mechanisms that have continued to be imposed that are politicized and meddlesome, and Cuba rejects this. The only effective way to strengthen the protection of human rights is through dialogue and cooperation based on a respect for sovereignty and the noninterference in internal matters. This Council further continues to be silenced unacceptably regarding the arbitrary and illegal UCMs imposed against Nicaragua. This is to the detriment of human rights for their people. Cuba calls, demands the immediate, uh, cessation of these measures. The Council has the obligation of ensuring an equal treatment of all states without discrimination or selectivity. We hope that the Council will continue to meet this principle in future cases of non-cooperation with the UPR, regardless of the size or economic power, financial or military power of the concerned State. Our delegation will join consensus as regards to decision L/62 in the understanding that this is a text that is essentially procedural in nature, and it does not prejudge our substantive position regarding the situation of human rights in any country. Let us leave clearly noted that Cuba will oppose in the future any attempt to adopt the UPR report on Nicaragua without having first received the addendum and due response from the concerned State. Any decision adopted on this matter with regard to any country and the UPR must respect the package of institutional cooperation and the principles that guide the operations of the UPR. Thank you very much, Mr. President.

Thank you.

Give the floor to the distinguished representative of China.

Mr. President, UPR is and a platform for countries to engage in equal, candid exchanges and constructive dialogue and cooperation in the UN on human rights, China supports all countries to actively participate in UPR. In view of the above, China associates itself with the consensus on L62. Meanwhile, we hope that the Council in future will treat all countries that do not participate in the UPI in the same manner. Thank you, President.

Thank you.

I don't see any other request for the floor at this point. Can I take it that the whole room supports L62? L62 has thus been adopted. Thank you very much.

We will now move

to explanations of vote and general comments after the vote on all resolutions adopted under agenda item 6. Are there any delegations requesting the floor? I don't see any requests for the floor. Thank you. We are moving on to proposals submitted under item 9. The Council will now consider draft proposal L.29/Rev.1, entitled "From rhetoric to reality: a global call for concrete action against racism, racial discrimination, xenophobia and related intolerance", I give the floor to the distinguished representative of Ghana on behalf of the African group to introduce the draft text.

Mr. President, on behalf of the African group, I have the honor to present draft resolution L29, rev 1, entitled, "From Rhetoric to Reality: A Global Call for Concrete Action Against Racism, racial discrimination, xenophobia, and related intolerance for adoption by this council. Through this annual resolution, the African group seeks to encourage states and regions to engage with and support the initiatives of the African Union relating to reparatory justice and reparations for Africans and people of African descent. with a view to fulfilling their responsibilities concerning slavery and colonialism in Africa and other parts of the world. In this regard, we urge states that have not yet taken measures towards redress to urgently initiate a comprehensive approach to address the legacies of the past through a plurality of measures, including through formal apologies, through telling processes, and reparations in various forms. We maintain that the debate on reparations and reparatory justice should go beyond rhetoric to concrete global action, including adherence to the previous commitments made for the full and effective implementation of the Durban Declaration and Programme of Action. It is worth recalling that the DDPA now nearing its 25th anniversary, recognizes that slavery, slave trade, and the transatlantic slave trade are a crime against humanity and should always have been so, and that they are among the major sources and manifestations of racism, racial discrimination, xenophobia, and related intolerance. Racism and all other forms of discrimination have no place in our societies. Mr. President, the African Union has seem it appropriate to extend the 2025 theme, namely, justice for Africans and people of African descent through reparations to a decade. We maintain that this theme remains a strategic rallying point to advance the aspirations of people of African descent and the importance of reinforcing the commitments to achieving justice and equity for African communities on the continent and in the diasporas. In closing, I wish to appeal to the members of this Council and the larger UN membership to support and ensure successful adoption of this resolution. Convergence on the anti-racism agenda will send a strong signal of a renewed sense of commitment to this cause by all. I thank you.

Thank you.

I have been informed by the Secretariat that there are two additional co-sponsors. And I give the floor to members of the Council who wish to make general comments. I give the floor to the distinguished representative of China.

Mr. President, the elimination of all forms of racism so that everyone has equality and dignity is the spirit of the UN Charter and the reflection of international equity. We support international community's efforts to implement Durban Declaration program action and take strong measures to combat all forms of racial discrimination and racism. We oppose spreading lies and provoking political confrontation under the guise of upholding racial equality and justice, all countries should adopt a zero tolerance towards racism and take measures to combat racism and violence in law enforcement, ban the spreading of hatred, racial hatred and eliminate immunity. We support African groups L29 draft resolution and we call on all members to join the consensus. Thank you.

Thank you.

I give the floor to the distinguished representative of Ethiopia.

Thank you, Mr. President. We thank the delegation of Ghana for the leadership in tabling this important resolution on behalf of the African group. As a co-sponsor of this resolution, Ethiopia aligns itself with its central message that it is time for the international community to move decisively from word to action. The legacy of slavery, colonialism, apartheid, and systematic racism continues to shape the lived experience of millions, particularly Africans and peoples of African descent. This resolution rightly calls for transformative change, including truth-telling, reparatory justice, education reform, and inclusive governance. Ethiopia remains deeply committed to the full and effective implementation of the Durban Declaration and Programme of Action and welcomes the proclamation of the Second International Decade for People of African Descent. We also echo the call to ensure that digital technologies are governed in a way that does not exacerbate racial discrimination, and we highlight the need for equitable access to those tools as part of our collective development efforts. Mr. President, we commend the resolution's emphasis on accountability, particularly in relation to systematic racism in law enforcement and migration governance. We believe that the dignity, safety, and rights of all individuals, regardless of race or origin, must be upheld without exception. In conclusion, Ethiopia urges all members of this Council to adopt this resolution by consensus. Let this serve as a global reaffirmation of our collective resolve to fight racism in all its forms and to advance equality, dignity, and justice for all. I thank you, Mr. President.

Thank you.

I give the floor to the distinguished representative of Kenya.

Thank you, Mr. President. Kenya calls for the adoption of this resolution by consensus as a powerful gesture to political goodwill and solidarity to the people of the world. Let this consensus demonstrate that the international community stands together, not only to condemn racism, but to confront and repair its enduring consequences. This resolution starts as a necessary reminder that rhetorical commitments cannot dismantle the entrenched legacies of racial injustice. From transatlantic slavery and colonial exploitation to contemporary structural racism, the relations have borne the brunt of inequalities that continue to shape the global order. To move from symbolism to substance requires deliberate and measurable action, including truth-telling, reparatory justice, and equitable international cooperation. For Kenya and for Africa as a whole, reparations are not a matter of charity or historical nostalgia. They are a demand for restorative justice. They represent a recognition that stolen labor, extracted wealth, and enduring structural discrimination must be addressed through tangible redress measures that empower affected communities and nations. The AU's thematic focus on reparatory justice and the proclamation for the second decade for people of African descent signals that not only through such acknowledgement and repair can the international community close the moral and political deficit left by centuries of racial subjugation. We therefore welcome the resolution's affirmation of the Durban Declaration and the Programme of Action as a comprehensive global framework to combat racism. We underscore that its full implementation, including reparations dimensions, remains central to achieving equality and dignity for all people. The struggle against racism and related intolerance cannot be selective or convenient. It must be universal, sustained, and guided by justice. Thank you.

Thank you.

I give the floor to the distinguished representative of Cuba.

President, We thank the delegation of Ghana for having presented, on behalf of the African Group, draft resolution L.29 Rev.1. It's an important opportunity to call for more concrete actions to fight racism, racial discrimination, xenophobia, and related forms of intolerance. Much remains to be done to defend the rights of Africans and Afro-descendants. Urgently, more practical measures are needed to eradicate the abhorrent discriminatory and racist practices that remain. This Council has the duty to energetically address the systematic violations of human rights committed against the Afro-descendants, particularly in some developed countries in which police brutality is frequent, as are racial discrimination institutionalized, disproportional incarceration, extrajudicial killings, and other repugnant practices. Cuba reiterates its full commitment to the full implementation of the Durban Declaration and Programme of Action. We'll continue to call as quickly as possible for the UN declaration for the full recognition of the rights of people of African descent. For this reason, Cuba supports and will vote in favor of L19 and Rev.1, and calls upon the members of the Council to do the same. Thank you very much, Mr. President.

Thank you.

I give the floor to the distinguished representative of Colombia.

Thank you, President. Colombia thanks the delegation of Ghana on behalf of the African Group in presenting L29 Rev.1 on racial discrimination, xenophobia, and related forms of intolerance. follow-up and implementation of the Durban Declaration and Programme of Action. The Global Conference Against Racism in 2001 was one of the main scenarios for the promotion of human rights. However, we agree with the African Group that the lack of knowledge over the Durban Declaration and its Programme of Action by the population in general has been a hindrance to its efficient or effective implementation. We cannot forget that slavery and the slave trade, particularly the transatlantic slave trade, are and always should have constituted a crime against humanity. We call for the implementation of mechanisms for restorative justice that respond to the different local contexts. and that address matters such as restitution, compensation, rehabilitation, satisfaction, and guarantees of non-repetition. Looking towards the 25th commemoration of the Durban Declaration and Programme of Action, the DPA, we call for a broad awareness campaign through numerous channels with the support of the High Commissioner's Office for Human Rights. Colombia's reconnection to the African continent through our President, Francia Marquez, is not either merely rhetorical or a work of fiction. It happens. It materializes as we, as a country, supports initiatives such as that proposed by the delegation of Ghana. For these reasons, Colombia has co-sponsored anew this year this draft resolution, L29 Rev.1. We invite the distinguished members of this Council to adopt it by consensus and move ahead hand in hand until the dignity of those affected by racial discrimination be addressed. Thank you very much, Mr. President.

Thank you.

I thank the interpreters for the additional time, but we have to continue consideration of L.29/1 tomorrow.

Excellencies, distinguished colleagues, this brings us to the end of this meeting. We will resume tomorrow morning at 10 o'clock to continue the consideration of draft resolutions and decisions. I hereby close the 42nd meeting of the 60th session of the Human Rights Council. Thank you and good evening.
